The Government of the country, the Ministry of Justice, Ministry of Internal Affairs, the Supreme court, General Prosecutor’s Office and other ministries and departments, research and analytical establishments carry out a significant work on realization of the Decree of the President of the Republic Uzbekistan No.UP-3641 “On abolishment of death penalty in the Republic of Uzbekistan” from August 1, 2005.
The Order of the President of the Republic of Uzbekistan “On measures to improve the legislation in the field of liberalizing the criminal punishment and judicial-legal system” authorizes the list of normative-legal acts, which are subject to adoption, amendments and additions in connection with death penalty abolishment and its replacement by life or long term imprisonment. Alongside with this, execution mechanisms of re-entered kinds of criminal punishments are worked out; measures on preparation of law enforcement bodies’ employees and judges are being worked out and realized for realization of justice and law enforcement practice according to the new criminal, criminal procedural legislation.
Hundreds of specialists: lawyers, economists, journalists, experts of various departments, state bodies, scientists and wide public, including representatives of “mahallyas” are involved in this work.
238 TV programs, 463 radio broadcasts, more than 270 publications in newspapers and magazines, 23 scientific-practical conferences, 148 seminars, 265 "round tables" were dedicated to discussion of the Decree on abolishment of death penalty.
The main task of the Order of the President of the Republic of Uzbekistan “On additional measures to prepare the legislative, normative-legal acts that are subject to adoption in connection with abolishment of death penalty in the Republic of Uzbekistan” is to intensify work on preparation of normative-legal acts related to elimination of death penalty from the system of criminal punishments, strengthening the organizational basis on the final stage of its realization.
What does this mean?
First, to generalize and consider numerous opinions and reasons stated in this occasion by thousands of people, representing various professions and social positions, and also the offers of public associations, citizens’ self-government institutions on the given question during the realization of projects of the normative-legal acts prepared in connection with death penalty abolishment.
Second, to summarize the results and recommendations of the seminars, conferences, “round tables” conducted on this topic and use them to introduce amendments and additions to Uzbekistan’s criminal legislation in connection with the abolishment of death penalty and its replacement by life or long-term imprisonment.
Third, to take into account the numerous judgments and remarks made in this regard by noted lawyers, politicians, foreign journalists, and experts from various international organizations and structures.
Thus, the most important task of the working group being established in accordance with the Decree of the President of the Republic of Uzbekistan is to summarize and systematize all these materials and to elaborate on their basis the schedule to prepare legislative and other legal acts that would ensure realization of the Decree on the abolishment of death penalty and submission of these documents to the Legislative Chamber of the Oliy Majlis of the Republic of Uzbekistan.
Timeliness of this Order is obvious. While the Decree of the President of the Republic of Uzbekistan from August 1, 2005 brings the question of abolishment of death penalty to the agenda, the Order of the President of the Republic of Uzbekistan from August 19, 2005 identifies those areas of legislation and legal acts that subject to amendment and addition. In order to adopt appropriate legal acts on these issues by the Oliy Majlis of the Republic of Uzbekistan, it is necessary to summarize and take into account new spheres and directions of legislations as well as problems that appeared for the period after those were adopted.
Only such a democratic approach that provides broad consensus of opinions of the public, experts, and specialists can ensure thoughtful, balanced and consistent work on the adoption of the legislative acts related to abolishment of death penalty in Uzbekistan.
