Immigration: Are You on the Deportation List?

Did you know that there is a deportation list? Most people are not aware that such a list exists. However, the fact that it is called the deportation list means no one actually wants to be on it. It must be known that any non-citizen in the U. S. can be deported or legally removed from the country under specific circumstances or conditions. Therefore, it is only wise that non-citizens avoid deportation. This is not difficult as long as all laws in the U. S. are followed and the individuals meet the criteria of their visa while in the country. When individuals fail to meet or follow the requirements of the law or their visa their names are placed on the deportation list. Despite the fact that the person's whose names appear on the deportation list are eligible for removal from the U. S. there are processes that must happen before the actual physical removal occurs.

There are a number of reasons that can result in a non-citizen being added to the deportation list, some of which are:

1.Overstaying a visa - each visa has an expiry date and the visa holder is required to either apply for an extension on the visa or leave the country by the expiry date. By staying longer than the expiry date on the visa this will result in deportation. If removed under these conditions of overstaying a visa, the visa holder will be denied a chance to return to the U. S. at any date or time.

2.Illegal entry - this includes providing incorrect information about the reason for one’s visit to the U. S. so as to gain entry at a legal entry point. Illegally entering the U. S. is a crime and will result in deportation. This includes permanent residents that stayed outside the U. S. for a long period of time, upon return they may be considered as entering illegally if he or she cannot prove their intention of returning before leaving.

3.Failure to pass a background check - thorough background checks are carried out for foreign citizens who apply for a visa, permanent resident status or for U. S. citizenship when in the U. S. Their failure to give accurate information on the application about any type of listed criminal charges can result in deportation. Also, falsifying information on the application is a crime on its own and will result in deportation.

4.Committing a serious crime in the U. S. - a non-citizen in the U. S. can be deported if guilty of serious crimes which fall into the category of aggravated felony and crimes of moral turpitude.

If your name is on the deportation list you will be served with a Notice to Appear and deportation proceedings will commence. Be sure to make every effort to have an immigration lawyer present to represent you at the hearing.
