Telemental Health Practice Over State Lines? Legal & Ethical Strategies

31 October 2016, San Diego, CA - Many mental health professionals have one or more misconceptions about licensure when providing telemental health services across state lines. Internationally recognized telehealth expert, Marlene Maheu, Ph.D., is scheduled to present a 1-hour webinar titled “Telemental Health Practice Over State Lines? Legal & Ethical Strategies” to help telehealth professionals understand licensure portability. The webinar will broadcast Wednesday, December 9, 2015 at 2 PM Eastern/11 AM Pacific.

Starting an online mental health practice may seem as easy as attaching a webcam, turning on one’s computer, and initiating a video chat, but most professionals are confused about the basic legal and ethical requirements, including licensure. They have questions about how to practice over state lines, exceptions to the rule and where to go for help in extenuating circumstances.

Understanding the basics of licensure portability and other interjurisdictional issues are essential to risk management when protecting one’s license to practice. This month, Dr. Marlene Maheu will present another free, 1-hour telemental health webinar entitled, “Telemental Health Practice Over State Lines? Legal & Ethical Strategies” to help you understand licensing laws and licensure portability.

Maheu explained, “You can most certainly practice over state lines if you know the research, understand the rules, and follow them closely. None of this is rocket science.” She further detailed, “Since 1959, behavioral professionals have been practicing over state lines both legally and ethically with telehealth.” In this convenient webinar, she will outline the essential functions of licensure, and where to get up-to-date facts about state-specific laws relevant to telepractice. Dr. Maheu will also identify the states that are leaders in the licensure portability movement (i.e. licensing over state lines) and which states make it difficult. Finally, she will discuss malpractice insurance, how it is dependent on following state and/or provincial law and describe the mechanisms by which malpractice coverage can automatically be nullified, despite a carrier's public claims. She then will share the one essential question to ask malpractice carriers about coverage for telepractice across state lines.
