Foreigners Can Buy Phuket Property Outright Without Travelling to Thailand, Real Estate Agency Undersun Estate Explains How

Foreign buyers have two routes, freehold and leasehold. A condominium unit can be bought freehold within the 49% foreign quota: under Thailand's Condominium Act, foreign owners may collectively hold up to 49% of the total saleable floor area of a registered condominium building. The alternative is a registered lease. Thai law caps a registered lease at 30 years, and agreements commonly carry contractual options for two further 30-year terms, which bind the original lessor without a statutory guarantee behind them. A villa can be held either way, and the building itself is registered in the buyer's name, while the land beneath it is available to foreign buyers on a lease. A lease can be assigned on resale and passed to heirs where the agreement provides for it and the terms are registered accordingly. The agency also maintains a proprietary pricing archive on Phuket projects dating back to 2018. It uses the archive to track how prices have actually moved across market cycles, which areas and projects appreciated, at what pace and on what drivers, and applies that history when assessing which projects carry the stronger upside.

The largest single transaction to date is 15 units bought by one client in one deal.
