According to Boston wrongful death attorney Dino M. Colucci, Massachusetts General Laws Chapter 229, Section 2 allows the executor or administrator of a deceased person's estate to pursue damages when a nursing home fails to provide a reasonable standard of care. Common causes of nursing home wrongful death include unwitnessed falls, inadequate staffing, medication errors, untreated infections, and failure to follow a resident's care plan. Attorney Colucci emphasizes that families may recover several categories of damages under G.L. c. 229, Section 2, including the fair monetary value of the decedent to the surviving family members, loss of care and companionship, funeral and burial expenses, and punitive damages of at least $5,000 when death resulted from willful, wanton, or reckless conduct. Conscious pain and suffering damages under Section 6 compensate the decedent's own experience between the time of injury and death.
