A central issue in many cases is comparative fault. Massachusetts follows a modified comparative negligence standard under M.G.L. c. 231, 85, allowing an injured person to recover damages as long as their own share of fault does not exceed 50 percent. "Insurance adjusters frequently use comparative fault arguments to reduce settlement offers," Colucci observes. "That is why fault allocation should be carefully evaluated before anyone accepts a payment." For instance, if a jury in Norfolk County Superior Court finds a pedestrian 20 percent at fault and awards $100,000, the injured person would receive $80,000 after the reduction.

Colucci emphasizes that strict filing deadlines apply to nearly every claim. Most personal injury actions must be filed within three years of the injury under M.G.L. c. 260, 2A, while claims against a municipality under the Massachusetts Tort Claims Act, M.G.L. c. 258, generally require a written presentment within two years and a lawsuit within three years. "Missing the applicable deadline can permanently bar a claim, no matter how strong the evidence," he advises.

Proving negligence requires establishing four elements: duty, breach, causation, and damages, each supported by evidence gathered from the scene, medical records, and witness accounts. Attorney Colucci highlights that gathering evidence quickly is critical, since physical conditions deteriorate and witness memories fade. Helpful evidence often includes police and accident reports, surveillance footage, photographs of the scene, medical records, and testimony from accident reconstruction or medical experts.
