Westchester County Delays Law Restricting Some Chemicals in Children’s Products

Westchester County, in New York State, has delayed enforcement of a new law prohibiting the sale of children’s products containing certain toxic chemicals. Westchester County plans to implement the law following the settlement of a similar law between Albany County and the Safe to Play Coalition.

In May 2015, Westchester County announced the adoption of a law ‘Prohibiting the Sale of Children’s Products Containing Certain Chemicals’. This legislation sought to ban the use of several chemicals in products being sold to children aged 12 or under and was expected to come into effect on May 15, 2016.

The proscribed substances included:
• Antimony
• Arsenic
• Benzene
• Cadmium
• Cobalt
• Formaldehyde
• Lead
• Mercury

The County Executive’s office has now informed the Toy Industry Association (TIA) that it has postponed enforcement of the law until after a similar law, in Albany County, has reached settlement. The Albany County law, Local Law No. 1 for 2016 (The Toxic Free Toys Act) aims to add a specific limit value to each of the chemicals listed in Local Law No. 1 for 2015 (also known as ‘The Toxic Free Toys Act’). The new law will take effect on July 1, 2016.
