Frankfurt-Karben, Germany / 3 July, 2009: exempt or not exempt? This is the question many aviation operators are still asking themselves, with just 60 days to go.

GALLEHR+PARTNER share knowledge and experience of EU-ETS Directive in their latest Newsletter focusing on “Who is really affected by the EU-ETS? A Recommended Approach” and become an IATA Strategic Partner in order to further promote understanding of environmental strategies in the Aviation Sector

In order to secure the free allocation of Emission Rights for Airline Operators through until 2020, it is crucial to submit monitoring plans to the relevant Competent Authority (CA) by August 31st. Even a small operator with CO2 Emissions of 15,000 tonnes yearly could stand to lose a free allocation with a value of approximately 300,000 €.

In their latest Newsletter (04/2009) GALLEHR+PARTNER highlight some of the complexities of the EU Directive and especially the “exemptions” which it contains. In working with aviation operators and communicating with the CAs throughout the last few months, the company has gained insights into many of these areas and has sought to share these with the industry. In short these recommendations are:

• Do not rely on the CA or the EU list of operators. Airlines should make their own assessment as to whether they are included in the system or not.
• If they do not submit the monitoring plan until August 31st this year, operators may not get any free allocation until 2020.
• From today, the deadline to submit both monitoring plans is within only 60 days!
• Submitted CO2 and t-km monitoring plans should give operators the maximum of flexibility in optimising their monitoring and reporting.

GALLEHR+PARTNER have joined the IATA (International Air Transport Association) Strategic Partnerships programme to further promote understanding of environmental strategies, and in particular understanding of the Emissions Trading Scheme and its potential impact on the aviation industry.

IATA seeks to improve understanding of the industry among decision makers and increase awareness of the benefits that aviation brings to national and global economies. The association is the primary industry forum through which Member airlines and their Partners develop global aviation standards. IATA is responsible for developing and shaping policies and practice for the conduct of air transport services within the international regulatory framework.
