Deca-BDE and HBCD/HBCDD Added to Priority Chemicals List in US

The US state of Maine has adopted proposals, originally issued in October 2016, to designate two new flame retardants as Priority Chemicals (PCs).

The two substances are:
• Decabromodiphenyl ether (Deca-BDE)
• Hexabromocyclododecane (HBCD/HBCDD)

These chemicals are added to a list that already includes:

• Bisphenol A (BPA)
• Formaldehyde
• Nonylphenols and nonylphenol ethoxylates (NPs and NPEOs)
• 3 Metals (arsenic, cadmium and mercury)
• 4 Phthalates (benzylbutyl phthalate (BBP), dibutyl phthalate (DBP), diethyl phthalate (DEP) and di-(2-ethylhexyl) phthalate (DEHP)

Manufacturers and distributors of certain types of child’s products are required to report the use of these two flame retardants if they are intentionally added and they exceed the practical quantification limit (PQL). Reporting must be made to the Department of Environmental Protection (DEP) within 180 days of the effective date.

The restrictions on Deca-BDE and HBCD/HBCDD relate to the following product types:

• Childcare articles
• Children’s clothing, footwear, sleepwear and toys
• Electronic devices
• Household furniture and furnishings
• Mattresses and mattress pads

Maine enacted its ‘Toxic Chemicals in Children’s Products’ Law in 2008. The law relates to any consumer product:

• For children under the age of 12
• Containing a chemical of high concern (CHC) that when used or disposed of will likely result in a child under 12 years of age or a fetus being exposed to that chemical.

The law mandates manufacturers, importers and distributors to inform the DEP if a product contains a prescribed chemical in excess of the de minimis level.

The updated rules became effective on March 4, 2017, with a deadline for reporting of August 31, 2017. Regulated children’s products offered for sale for the first-time only after the end of August 2017, are obliged to report to the DEP within 30 days of the children’s product going on sale.
