Waterbury Motorcycle Accident Attorney Dan Petroskey Explains Rider Rights and Compensation Under Connecticut Law
WATERBURY, CT - August 27, 2026 - Motorcyclists traveling on major roadways such as Route 8 and I-84 face distinct safety challenges, and collisions frequently result in severe, life-altering injuries due to the lack of structural protection inherent to motorcycles. Waterbury motorcycle accident attorney Dan Petroskey of DeFronzo & Petroskey, P.C. (https://www.defronzolawfirm.com/waterbury-car-accident-attorney/motorcycle-accidents-ct/) has published guidance addressing the common causes of motorcycle crashes, the injuries riders often suffer, and the legal options available to those harmed by another party's negligence.According to the Connecticut Department of Transportation, there were 59 motorcycle fatalities statewide in 2023. Waterbury motorcycle accident attorney Dan Petroskey notes that identifying the true cause of a crash early is essential, as it determines who can be held responsible and where compensation will come from. "Motorcyclists have no protective shell to absorb impact, which is why these collisions so often leave riders facing surgery, long rehabilitation, and time away from work," Petroskey explains.
Waterbury motorcycle accident attorney Dan Petroskey outlines three primary causes of serious motorcycle crashes in the area: another driver's negligence, dangerous road conditions, and defective motorcycle equipment. Negligent drivers account for the largest share of these collisions, often through left-turn accidents at intersections, failing to check blind spots, or pulling out from side streets. When potholes, loose gravel, or uneven pavement contribute to a crash, the city of Waterbury or the State of Connecticut may share liability, and when a faulty brake, tire, or throttle fails, a manufacturer may be responsible under product liability law.
Petroskey points out that Connecticut follows a modified comparative negligence rule under Connecticut General Statutes 52-572h. Injured riders may recover damages as long as they are not more than 50 percent at fault for the crash, though any recovery is reduced by the rider's percentage of blame. "Insurance companies know this rule well, and they often try to shift blame onto the rider by arguing the motorcyclist was speeding, lane splitting, or hard to see," Petroskey says. "Pushing back on those arguments with solid evidence protects the value of the claim."
The firm advises that riders may pursue both economic damages, such as medical bills, future treatment, lost wages, and motorcycle repair, and non-economic damages, including pain and suffering, emotional distress, and disfigurement. When a crash is fatal, surviving family members may pursue a wrongful death claim covering funeral costs, loss of financial support, and loss of companionship.
Timing is a critical factor in every motorcycle claim. Attorney Petroskey explains that Connecticut generally allows two years from the date of the accident to file a personal injury lawsuit under Connecticut General Statutes 52-584, and missing this deadline almost always means losing the right to compensation. Certain exceptions apply, including the discovery rule for injuries that were not immediately apparent and tolling provisions for injured minors, but claims against a government entity carry far shorter deadlines. When a defective municipal road causes a crash, a formal written notice must be filed within 90 days under Connecticut law.
Petroskey also cautions riders against several common missteps that can weaken an otherwise strong claim. Giving a recorded statement to an insurer before consulting an attorney, accepting an early settlement offer before the full extent of injuries is known, and delaying medical treatment can each significantly reduce recovery. "A quick settlement offer rarely reflects the full value of a case, and once a release is signed, the claim generally cannot be reopened even if the injury worsens," he emphasizes.
Addressing helmet requirements, Petroskey notes that as of October 2025, Connecticut requires helmets for all riders and passengers under the age of 21 and for anyone operating with a motorcycle instruction permit, while adult riders 21 and older with a full endorsement are not legally required to wear head protection. He observes that adjusters sometimes attempt to use a missing helmet to justify a lower payout, but courts routinely reject this argument for adults who were operating legally.
DeFronzo & Petroskey, P.C. represents injured riders in Waterbury and throughout the surrounding communities, including Naugatuck, Wolcott, Middlebury, Prospect, Cheshire, Ansonia, Derby, Shelton, and Torrington, as well as other areas across New Haven County and Litchfield County. Most Connecticut motorcycle cases resolve through negotiated settlements, though the firm notes that a credible readiness to try a case gives injured clients meaningful leverage during negotiations.
For those injured in a motorcycle crash, contacting an experienced Waterbury personal injury attorney may help protect their legal rights, preserve important evidence, and pursue fair compensation for medical expenses, lost wages, and other damages.
