"They may dispute injury severity or argue that the victim shares fault for the collision."

The firm notes that Connecticut follows a modified comparative negligence rule, which allows injured parties to recover compensation as long as their share of fault does not exceed 50 percent. If fault is assessed, total compensation is reduced proportionally. For example, a $200,000 award reduced by 20 percent fault would result in a $160,000 recovery. This makes gathering evidence quickly after a head-on crash critical, including police reports, witness statements, traffic camera footage, and vehicle electronic data.

Petroskey advises that under Connecticut General Statutes Section 52-584, most negligence injury claims must be filed within two years of when the injury is first sustained or discovered, and no later than three years from the date of the act or omission.
