Milton Personal Injury Attorney Dino M. Colucci Outlines Compensation Options for Norfolk County Accident Victims
MILTON, MA - Accidents can happen in an instant, but the physical, emotional, and financial consequences can last for months or even years. Milton personal injury attorney Dino M. Colucci of Colucci, Colucci & Marcus, P.C. (https://www.coluccilaw.com/milton-injury/) is providing guidance to help accident victims understand the types of claims they can pursue, the Massachusetts laws that govern injury cases, and the compensation available when negligence causes harm. Whether an injury results from a car accident, unsafe property conditions, a dog attack, or another act of negligence, Massachusetts law may allow the injured person to seek compensation for medical expenses, lost income, pain and suffering, and other losses.According to Milton personal injury attorney Dino M. Colucci, motor vehicle collisions remain the most common source of injury claims in Norfolk County, particularly along high-volume corridors such as Route 138/Blue Hill Avenue and Route 28/Randolph Avenue. Massachusetts operates under a no-fault auto insurance system, in which Personal Injury Protection can cover medical expenses, up to 75 percent of lost wages, and replacement services, with a total limit of $8,000, regardless of fault. "Many people don't realize that a separate tort threshold applies before they can pursue pain-and-suffering damages," Colucci explains, noting that those damages generally require more than $2,000 in reasonable and necessary medical expenses or a qualifying injury such as permanent and serious disfigurement or a fracture.
Milton personal injury attorney Dino M. Colucci points out that premises liability and dog bite cases follow their own legal standards. Property owners in Massachusetts owe a duty of reasonable care to people lawfully on their premises, a modern standard established by the Massachusetts Supreme Judicial Court in Mounsey v. Ellard, 363 Mass. 693 (1973). Massachusetts also imposes strict liability for dog-related injuries under M.G.L. c. 140, 155, generally holding owners responsible even when the animal has no prior history of aggression, subject to limited statutory exceptions.
When a person dies due to another party's negligence, the executor or administrator of the estate may file a wrongful death action under M.G.L. c. 229, 2. Colucci notes that recoverable damages may include funeral and burial expenses, loss of expected income, and loss of the decedent's care, companionship, and guidance. Such actions must generally be filed within three years of the date of death or within three years of when the estate's representative knew, or reasonably should have known, the factual basis for the claim.
A central issue in many cases is comparative fault. Massachusetts follows a modified comparative negligence standard under M.G.L. c. 231, 85, allowing an injured person to recover damages as long as their own share of fault does not exceed 50 percent. "Insurance adjusters frequently use comparative fault arguments to reduce settlement offers," Colucci observes. "That is why fault allocation should be carefully evaluated before anyone accepts a payment." For instance, if a jury in Norfolk County Superior Court finds a pedestrian 20 percent at fault and awards $100,000, the injured person would receive $80,000 after the reduction.
Colucci emphasizes that strict filing deadlines apply to nearly every claim. Most personal injury actions must be filed within three years of the injury under M.G.L. c. 260, 2A, while claims against a municipality under the Massachusetts Tort Claims Act, M.G.L. c. 258, generally require a written presentment within two years and a lawsuit within three years. "Missing the applicable deadline can permanently bar a claim, no matter how strong the evidence," he advises.
Proving negligence requires establishing four elements: duty, breach, causation, and damages, each supported by evidence gathered from the scene, medical records, and witness accounts. Attorney Colucci highlights that gathering evidence quickly is critical, since physical conditions deteriorate and witness memories fade. Helpful evidence often includes police and accident reports, surveillance footage, photographs of the scene, medical records, and testimony from accident reconstruction or medical experts.
The firm notes that Massachusetts law allows victims to recover both economic damages, such as medical bills and lost wages, and non-economic damages for pain and suffering. Massachusetts does not impose a general statutory cap on pain-and-suffering damages in most non-medical-malpractice, non-government personal injury cases. In larger claims heard in Norfolk County Superior Court, expert economic testimony is often necessary to project future medical needs and lost earning capacity.
Colucci, Colucci & Marcus, P.C. represents clients throughout Milton, Canton, Randolph, Quincy, Braintree, Weymouth, Stoughton, Holbrook, Avon, and the surrounding Greater Boston communities. Most cases settle before trial, though the firm prepares every matter as if it will go to court, with the client retaining the final say on any settlement offer.
For those injured in Milton or anywhere in Norfolk County, contacting a personal injury attorney may help protect important evidence, meet statutory deadlines, and pursue compensation under Massachusetts law.
