Texas attorney Katie Nielsen of Carthage says many of life's most difficult legal disputes begin with conversations that families avoid having until it's too late.

According to Texas attorney Katie Nielsen, those conversations are often far easier than dealing with the legal and emotional consequences of never having them at all.

Throughout her career representing clients in family law, probate, estate planning, civil litigation, and criminal matters, Nielsen has seen how misunderstandings, assumptions, and unspoken expectations can turn already difficult situations into lasting family conflict.

Research shows these discussions are often delayed. According to Caring.com, nearly 70% of American adults do not have a will, while AARP has found that many families avoid talking about aging, long-term care, or future planning until a health crisis forces those conversations. By then, emotions are often running high, and decisions become far more difficult.

Nielsen believes the issue extends well beyond legal documents.

"Every family is different," she said. "The goal isn't to have perfect answers. It's to make sure people understand one another before decisions have to be made under pressure."

She encourages families to start with simple conversations rather than waiting until circumstances leave little time to prepare. Talking openly about expectations, responsibilities, healthcare wishes, financial planning, aging parents, and where important information is kept can help reduce confusion and unnecessary stress later.

"People often assume they'll have more time," Nielsen said. "Life doesn't always give us that opportunity."

The National Institute on Aging encourages families to discuss future care preferences before a medical emergency occurs, noting that advance conversations can make decision-making less stressful for everyone involved. Financial experts have also found that misunderstandings surrounding inheritance, caregiving responsibilities, and family expectations are common sources of conflict after a loved one becomes ill or passes away.

For Nielsen, preparation is not about expecting something to go wrong. It is about allowing families to make thoughtful decisions together while they still have the time and ability to do so.

"The best outcome is often the problem that never becomes a legal dispute," Nielsen said. "A conversation today can prevent confusion, disagreement, and unnecessary stress tomorrow."

What Families Can Do This Week

Katie Nielsen encourages families to take a few simple steps before a crisis occurs:
- Set aside time for an honest conversation about plans instead of waiting for an emergency.
- Talk with aging parents about their wishes while they can comfortably share them.
- Discuss who would make important healthcare or financial decisions if someone became unable to do so.
- Make sure trusted family members know where important documents and key information are stored.
- Talk openly about caregiving expectations before they become immediate responsibilities.
- Encourage every family member to ask questions rather than make assumptions.
- Revisit these conversations every few years as circumstances change.

"These conversations don't have to solve every problem in a single afternoon," Nielsen said. "The important thing is simply getting started."

She hopes more families will recognize that planning is not about preparing for the worst. It is about reducing uncertainty, protecting relationships, and giving loved ones greater peace of mind.
