Real Estate Agent Continuing Education Scrapped?: Reducing Bureaucracy with Unintended Consequences
The Bundestag today abolished the requirement for regular continuing education for real estate agents (Section 34c(2a) of the Trade Regulation Act, Section 15b of the Real Estate Agent Ordinance). The rationale: reducing bureaucracy and the assumption that agents will take personal responsibility for their qualifications. For many in the industry, this is a double-edged signal.Supporters of the repeal point to the high administrative burden on trade licensing offices. Verifying proof of continuing education would tie up personnel resources and complicate administrative processes. Critics, however, warn that the public perception of the profession will suffer as a result. The public still holds the persistent view that a real estate agent needs nothing more than a business license--an impression that many associations have been fighting for years.
The real estate association IVD and numerous agents are instead calling for mandatory basic training. The goal: quality assurance and improving the profession's image. This is because an agent's work involves legal, tax, and contractual issues, as well as negotiation and advisory tasks that are difficult to handle without solid training. In the view of many practitioners, a lack of expertise repeatedly leads to mistakes that unsettle consumers.
One possible compromise draws on models from abroad. Harald Blumenauer of BLUMENAUER Immobilien shares his experiences in the U.S.: There, newcomers to the profession take a basic exam and initially work under the supervision of an established real estate agent as a freelancer or employee. After about three years of professional experience, a more demanding exam can be taken; only then is full self-employment customary. This tiered model combines practical experience with supervised responsibility.
As a practical implementation, industry representatives propose involving the Chambers of Industry and Commerce (IHK) more closely. The IHKs already offer modular courses ranging from beginner to advanced levels. An IHK-certified tiered model would professionalize technical and practice-oriented training without burdening local authorities with additional examination requirements.
Harald Blumenauer continues: "Training must not merely impart theory. Many problems in a real estate agent's daily work can only be solved through experience. That is why training programs should combine mandatory practical phases, mentoring by experienced agents, and tiered examinations. This strengthens the quality of service and protects consumers."
The elimination of continuing education certificates may reduce administrative burdens in the short term. In the long term, however, there is a risk of a loss of trust if no credible alternatives are established to ensure competence and practical relevance. The industry now has a responsibility to create independent, transparent quality standards--to protect customers and strengthen the profession's reputation.
