KEY FINDINGS FROM THE REPORT

HB 1203 transforms HOA governance in Florida with provisions that carry real criminal consequences:

• Kickbacks Are Now a Third-Degree Felony: Board members or managers who solicit, offer to accept, or accept kickbacks from vendors or contractors face up to 5 years in prison.

• Election Fraud Is a First-Degree Felony: Rigging HOA elections, aiding election fraud, or concealing voting fraud carries penalties of up to 30 years.

• Destroying Financial Records Is a Crime: Intentionally defacing or destroying accounting records is a first-degree misdemeanor carrying up to 1 year in jail. Refusing to release records to obstruct justice is a third-degree felony.

• Debit Cards Are Banned: Any use of a debit card issued in the HOA's name is now prohibited. Misuse is legally classified as theft.

• Mandatory Website for HOAs with 100+ Parcels: As of January 1, 2025, these HOAs must maintain a website where members can access financial records, budgets, contracts, and meeting minutes. HOAs not in compliance are already in violation of the law.

• Fines Are Capped and Regulated: Maximum fine is $100 per violation, capped at $1,000 for continuing violations. Fines under $1,000 cannot become a lien on the homeowner's property. If a homeowner fixes the violation before the hearing, no fine can be imposed.

• Pickup Trucks Are Protected: HOAs can no longer ban personal vehicles - including pickup trucks - from a homeowner's driveway.

• Interior Freedom: HOAs have zero authority over the interior of a home if changes are not visible from the street or common areas.

• Preferred Vendor Lists Are Unenforceable: HOAs cannot force homeowners to use a preferred contractor or ban workers who are not on an approved list.
