Flexible Estate Planning for Families: Tseng Law Firm Highlights Key Benefits of Pot Trusts
In helping families plan for the future, Tseng Law Firm is shedding light on the advantages of pot trusts-an increasingly popular estate planning tool for parents with multiple children, particularly when some are still minors or navigating early adulthood. Unlike traditional trusts that divide assets equally among beneficiaries, pot trusts allow for greater flexibility by giving a designated trustee the discretion to allocate funds based on each child's unique financial needs. This approach often results in more equitable support for dependents with differing education, health, or life circumstances."Pot trusts can be especially powerful for families with children at different stages of life," said Sabrina Tseng, attorney and owner of Tseng Law Firm. "When one child needs tuition support while another may not yet have reached school age, a rigid 50/50 division simply may not make sense. A pot trust takes that into account and empowers the trustee to make decisions that truly reflect a family's values and goals." However, Tseng cautions that this flexibility also depends heavily on selecting a trustee capable of making fair, informed decisions over time.
Used most often by families with two or more children, pot trusts are particularly effective when siblings have substantial age gaps or vastly different needs. Additionally, they are best suited for situations where parents intend to pass their entire estate to their children and want to ensure that all beneficiaries are cared for appropriately until a designated age or milestone. When properly designed, a pot trust can help prevent future disputes and protect assets during the critical years of development and education.
Tseng also emphasized the importance of reviewing and updating pot trusts regularly, particularly as children mature and their financial circumstances evolve. "This is not a 'set it and forget it' solution," she said. "Families should work with an experienced estate planning attorney to revisit their plans every year or so, especially if life changes occur."
