Patient Fairness Emphasizes Consumer Protection Solutions

A July federal court ruling has blocked the Consumer Financial Protection Bureau's (CFPB) January rule that would have removed unpaid medical debt from consumers' credit reports.

The court found that the CFPB exceeded its statutory authority under the Fair Credit Reporting Act. While some states like Colorado and New York have enacted their own protections, most Americans remain subject to adverse credit reporting of medical debts over $500.

One hundred million Americans, and four in ten adults, have some form of health care related debt. Among these adults with health care debt, more than a third said their health care debt had negatively affected their credit score.
In response, Patient Fairness today emphasizes the importance of its medical bill dispute services to help individuals keep medical debt from unfair bills appearing on their credit reports.

"The U.S. District Court's decision to block the removal of all medical debt on credit reports underscores the need for consumers to protect themselves against debt from unfair medical bills," said Matthew Ungs, president of Patient Fairness.

"The best way for patients to avoid adverse credit reporting from medical debt is to challenge unfair medical bills before they become recognized debt. For years, we've helped consumers formally dispute unfair medical bills, and further, to dispute attempts to place the bill with a debt collector or include disputed medical bills in credit reporting. With this court ruling, patients will need to be prepared to fight unfair medical bills and associated debts to protect their credit scores.

Patient Fairness is a key resource for patients to protect themselves, especially after the CFPB's protection has been overturned. Patient Fairness offers a proven, consumer-driven approach to disputing unfair medical bills and associated debts, including:

Review for and identification of nearly 100 reasons to dispute a patient's medical bill, including federal and state laws, inaccurate billing, failure to agree on prices prior to services, and balance billing above insurance cost-sharing
Professional dispute letter generation and mailing
Analysis of medical bill charges, including comparisons to a hospital's actual costs to deliver services, how much Medicare would pay for the same billed services
An easy-to-follow process to initiate and manage the dispute

"Laws and regulations can be powerful tools to protect a patient's creditworthiness from an unfair medical bill and associated debt," added Ungs. "However, even without some of those laws and regulations, Patient Fairness is helping patients protect themselves and their financial futures."
