BFSG countdown: Real estate agents & residential property managers must deliver accessibility now

June 23, 2025 - In just five days, the Accessibility Improvement Act (BFSG) comes into force. It also obliges real estate agents and residential property managers to make their digital touchpoints - from property exposés to tenant portals - accessible. Failure to ensure accessibility could result in fines of up to 100,000 euros and, in extreme cases, the website being shut down.

What applies from June 28, 2025?

Websites & online portals must comply with the requirements of the EN 301 549 standard (WCAG 2.2 AA). There are no transition periods for broker and administrator websites.

Digital documents such as PDF exposés, reservation and rental contracts must be prepared in such a way that screen readers can output them correctly.

Tenant apps and customer portals are also covered by the law as "e-commerce services".

Micro-enterprises (≤ 10 employees and ≤ €2 million turnover) enjoy an exemption, but must prove why implementation would be disproportionate.

Risks of non-compliance

Non-compliance can - in addition to fines - lead to injunctions, warnings under competition law and considerable reputational damage. The market surveillance authorities will investigate any information provided by consumers and impose measures up to and including the deactivation of the offer.

Three immediate steps for the industry

Accessibility audit (48 h): Check websites, PDF downloads, virtual tours and contact forms for WCAG compliance.

Accessible exposés: Use structured tags, alt texts for floor plan graphics and sufficient contrast.

Training & process fixes: Sensitize marketing, IT and property teams to accessible content and embed accessibility in your editorial workflows.
