Data misuse at SCHEELEN AG

Due to current events, biotonus must inform its partners, customers and employees that SCHEELEN AG has committed significant legal violations and data misuse.

In particular, Mr. Frank M. Scheelen personally passed on customer and partner-specific knowledge, internal correspondence and highly sensitive data records to unauthorized persons, made them available for inspection and used them for unauthorized contact. This represents a considerable degree of data misuse that must be prosecuted under criminal law and also violates competition law.

Furthermore, SCHEELEN AG, in particular through CEO Frank M. Scheelen, is "damaging the reputation" of biotonus Corp. and its responsible Board of Directors through false statements made in full knowledge, untruthful rumors and the deliberately controlled uncertainty of business partners and customers to the detriment of biotonus Corp. and its partners.

biotonus has already initiated criminal and civil proceedings to stop this. We advise all customers, partners and employees of biotonus to request SCHEELEN AG to DELETE all their personal data records and internal correspondence and, if necessary, to have the contractual basis with SCHEELEN AG examined by an experienced specialist lawyer. biotonus Corp. assures all partners and customers legal support in the enforcement of their personal rights against SCHEELEN AG, who have used the offers of SCHEELEN AG via biotonus.

biotonus will also forward this incident to TTI Success Insights®, as it is the licensor for the SCHEELEN Group's analysis tools. biotonus Corp. asks all customers, partners and employees to report any contact by employees or partners of SCHEELEN AG and its subsidiaries to the Board of Directors of biotonus Corp. so that appropriate legal action can be taken.

Due to this misuse of data by SCHEELEN AG towards a contractual partner, any other contractual partners of SCHEELEN AG should carefully review their contracts and cooperation with SCHEELEN AG and, if necessary, have them reviewed by a lawyer or attorney. SCHEELEN AG's insistence on collecting money for services not rendered, in addition to the written notifications to the biotonus Management Board, also calls into question SCHEELEN AG's liquidity. We advise business partners of the SCHEELEN Group to review their contracts and, if necessary, to demand security deposits.
