Clearwell Systems E-Discovery Advisor Appointed Adjunct

MOUNTAIN VIEW, Calif. – August 4, 2010 — The Charleston School of Law has appointed Brandon D’Agostino, an e-discovery solutions consultant at Clearwell Systems, Inc., a leader in intelligent e-discovery, as an adjunct professor. D’Agostino, a 10-year veteran of the IT field and a JD graduate from the Charleston School of Law, will partner with associate professor Allyson Haynes, a member of the Sedona Conference, to offer a course on the legal, technological and ethical issues surrounding e-discovery.

Electronic discovery (e-discovery) has traditionally been a topic overlooked by many law schools, even as it has grown steadily in importance and now impacts the careers of most attorneys. In adding e-discovery to its curriculum, the Charleston School of Law furthers its commitment to providing its students with expert legal training and education. Industry experts D’Agostino and Haynes will discuss the federal rules that apply to e-discovery and the growing body of case law focusing on document retention, cost allocation, spoliation, computer forensics and other discovery issues as they apply in the electronic context. Through hands-on, practice-based training, the course will familiarize students with the e-discovery lexicon and inform on legal implications around the growing body of electronically stored information (ESI), such as specifying form of production, negotiating search terms, maintaining regular information management systems, ordering litigation holds, navigating metadata and avoiding judicial sanctions.

At Clearwell Systems, D’Agostino serves as a consultant, advising AMLAW 100 and Fortune 1000 legal professionals on e-discovery topics such as data collection and preparation, dataset cull-down, data processing and analytics, early case assessment, and search query execution and refinement. Prior to Clearwell, D’Agostino was ESI Counselor for a large health insurer, where he acted as the in-house e-discovery counsel and created policies and workflow for e-discovery and information management. He performed ESI collections across multiple data sources using forensically sound methodologies and managed the daily operational tasks related to e-discovery such as ESI preservation, litigation hold management, ESI collection, processing, analysis, and review.
