U.S. Discovery - Where the battle is often won or lost

A small medical device company in Ohio successfully defended its intellectual property against a Fortune 50 company. The dispute spanned 12 years and 2 oceans, and produced 3 separate settlements, totaling $7M, and a lengthy non-compete. Yet, the U.S. district court never made a single decision on the merits. How did this happen? It happened via the tactical advantages achieved through U.S. dicovery, with critical help supplied by parallel efforts in Germany.
