Singapore Expands its List of Controlled Hazardous Substances

Singapore has introduced measures to regulate short-chain chlorinated paraffins (SCCP), polychlorinated naphthalenes (PCN) and trichlorfon. The Singapore government is expanding its list of regulated hazardous substances, under the Environmental Protection and Management Act (EPMA), by introducing two amendments:

• S 782/2017 – ‘Environmental Protection and Management (Hazardous Substances) (Amendment) Regulations 2017
• S 783/2017 – ‘Environmental Protection and Management Act (Amendment of Second Schedule) (No. 3) Order 2017

S 782/2017 will add PCN and SCCP to the list of hazardous substances included in the Schedule of the EPM (Hazardous Substances) Regulations (Rg 4). This requires any organization planning to import, store, sell or export listed substances, to gain a license and permit.

S 783/2017 makes two important changes to Part 1 of the Second Schedule to the EPMA, relating to ‘Control of Hazardous Substances’, and Part II of Second Schedule to the EPMA, relating to ‘General Exemptions’

The changes to Part 1 are:

• Trichlorfon will be regulated as one of the controlled hazardous substances under ‘Phosphorus compounds used as pesticides’
• PCN and SCCP will be included but with no specific exemption for either substance

The changes to Part 2 generally prohibit the use of PCN and SCCP in:

• Adhesives
• Lubricants
• Paints
• Plastics

In essence, S 783/207 is placing a general prohibition on the use of PCN and SCCP as constituent parts of substances used in mixtures and/or products.

The original announcement was circulated by the World Trade Organization (WTO) in November 2017, with the two amendments being published in December 2017. The measures will come into effect on June 30, 2018. Stakeholders are now advised to check their products comply with the current rules for entry onto Singapore’s market.
