KRCL Obtains Defense Verdict in Catastrophic Trucking Accident

On April 29, 2009, Zach Mayer and Aaron Speer of KRCL obtained a defense verdict for a national trucking company in defending a catastrophic brain injury case. The Plaintiffs alleged that the driver was negligent in his operation of a tractor and two trailer units while acting in the course and scope of his employment. Furthermore, the Plaintiffs alleged negligent hiring, training and supervision against the carrier. KRCL prevailed on a motion for summary judgment as to the negligent supervision, training and hiring claims. The case did not settle after two mediations with the Plaintiffs' final demand remaining at over $10 million. The case proceeded to trial and the Plaintiffs put on damages in excess of $10 million dollars through a life care planner and economist. After a three day trial in the United States District Court for the Eastern District of Marshall, the jury found no negligence on the part of the Defendants.
