EU Tightens Restrictions on Lead in Toys

The European Union (EU) has tightened restrictions on lead migration for all three of the toy material categories by a factor of approximately seven.

These toy material categories are:

1. Category I - Dry, brittle, powder-like or pliable, e.g.:
a. Chalk, compressed paint tablets, crayons, plaster of Paris, magic sand, modelling compounds and plasticine
b. Oven hardened PVC modelling compounds and bouncing putties
2. Category II - Liquid or sticky toy, e.g.:
a. Bubble solutions, finger paints, liquid adhesives, poster paints and slimes
3. Category III - Scraped-off, e.g.:
a. Ceramics, glass, metals and metal alloys, textiles and wood
b. Elastomers, leatherettes, polymers and surface coating materials
c. Other materials such as bones, leather and natural sponges

The new restrictions call for far more vigorous restrictions than previously required by Annex II of Directive 2009/48/EC, the so-called Toy Safety Directive (TSD). The new legislation calls for limits of:

1. Category I – 2.0 mg/kg (reduced from 13.5 mg/kg)
2. Category II – 0.5 mg/kg (reduced from 3.4 mg/kg)
3. Category III – 23 mg/kg (reduced from 160 mg/kg)

These changes were adopted by the Council of the EU in the first quarter of 2017 and were published, as Directive (EU) 2017/38, in the Official Journal of the European Union (OJEU) on April 28, 2017. The new restrictions will become effective on October 28, 2018.
