US CPSC Approves Final Rule for Infant Bath Tubs Safety Standard

The U.S. Consumer Product Safety Commission (CPSC) has approved its final rule for an Infant Bath Tubs safety standard with a unanimous vote of 5-0. The safety standard refers to voluntary standard ASTM F2670-17 Standard Consumer Safety Specification for Infant Bath Tubs, as the mandatory federal safety standard for Infant Bath Tubs.

Infant Bath Tubs are defined in ASTM F2670-17 as a “tub, enclosure, or other similar product intended to hold water and be placed into an adult bath tub, sink, or on top of other surfaces to provide support or containment, or both, for an infant in a reclining, sitting, or standing position during bathing by a caregiver.”

The final rule covers a number of designs, including:

• “Bucket style” tubs that support a child sitting upright
• Tubs with an inclined seat for infants too young to sit unsupported
• Inflatable Tubs
• Foldable Tubs
• Tubs with spa features (e.g. handheld shower attachments)
• Tubs with ‘whirlpool’ settings

According to statistics released by the CPSC, between January 2004 and December 2015, a total of 247 infant bath tub injuries or deaths were reported. These figures include 31 fatalities.

The Infant Bath Tub safety standard was finalized on March 15, 2017, in accordance with section 104(b) of the Consumer Product Safety Improvement Act of 2008 (CPSIA) and amends the list of Notice of Requirements (NORs) issued by the Commission under 16 CFR Parts 1112 and 1234.

The rule will then become effective six months after it is published in the Federal Register.
