DUBAI LAW FIRM, TRENCH & ASSOCIATES (T&A), ADVISE LEGAL ADVICE FOR WILLS.
DUBAI LAW FIRM, TRENCH & ASSOCIATES (T&A), ADVISE LEGAL ADVICE FOR WILLS.• T&A advises seeking legal advice and support when registering Wills
• DIFC Wills offer a transparent and legal route for non-Muslim expats, but legal advice is beneficial to ensure safeguarding non-moveable assets and naming Guardianship is correctly registered
March 19, 2017, Dubai UAE: Trench & Associates (T&A), established Dubai legal consultants, advise seeking good legal advice when drafting Wills in the UAE. This will ensure that Wills are correctly registered ensuring that wishes regarding non-moveable assets and Guardianship are securely upheld.
The DIFC Wills and Registry which was established in 2015 offers an absolute degree of legal clarity and certainty for non-Muslim expats wishing to protect their assets and register Guardianship for their dependents under the age of 21. This comes as a welcomed move, given the abundance of non-legal advisors who have often offered misguided advice.
The UAE Personal Status Courts of First Instance which preside over Inheritance apply Shari’ah Law while the DIFC Wills and Probate Registry gives non-Muslim expats the option to choose the DIFC Courts as an alternative. Full, Property and Guardianship Wills are now available and Property Wills are a welcome addition for those who have a maximum of 5 properties in Dubai and Ras Al Khaimah. DIFC Registration fees for Property Wills are reduced and make economic sense for those who wish to have a no-fuss route taken for the disposition of their real estate.
“Setting out to arrange something as important as a Will has profound implications for loved ones. The DIFC Wills and Probate Registry strongly advises considering legal advice in this process. Trench & Associates is fully approved and recommended by the Registry for preparing DIFC Wills. It therefore makes good sense to get the best legal advice possible as this will ensure peace of mind and full assurance that such an important legal document is done correctly.”
