Seychelles Proposes a Ban on Certain Plastics and Identifies Standards for Biodegradable Replacements

Seychelles Proposes a Ban on Certain Plastics and Identifies

The Republic of Seychelles has published proposals to ban plastic utensils, polystyrene boxes and certain plastic bags. In addition, it has issued proposals requiring biodegradable forms of these products to conform to prescribed standards. The affected products are under HS Codes 392321, 392329, 392410 and 392310.

These two pieces of draft legislation relate to both the plastic products that are to be restricted and the guidelines for the biodegradable versions. They are:

• Environment Protection (Restriction on manufacturing, importation and distribution of Plastic Bags) Regulations 2017
• Environment Protection (Restriction on importation, distribution and sale of Plastic Utensils and Polystyrene Boxes) Regulations 2017

Biodegradable products, compliant with both of these pieces of draft legislation, must conform to the following international standards:

• AS 4736-2006 ‘Biodegradable plastics – biodegradable plastics suitable for composting and other microbial treatment’
• ASTM D6400 ‘Standard specification for labeling of plastics designed to be aerobically composted in municipal or industrial facilities’
• EN 13432 ‘Packaging. Requirements for packaging recoverable through composting and biodegradation. Test scheme and evaluation criteria for the final acceptance of packaging’
• ISO 14855 ‘Determination of the ultimate aerobic biodegradability and disintegration of plastic materials under controlled composting conditions - Method by analysis of evolved carbon dioxide’

The two pieces of proposed legislation are being issued under the Environment Protect Act, 2016, and were circulated on February 7, 2017, by the World Trade Organization (WTO) in WTO document 17-0713.

Stakeholders should be aware that the proposals direct the Bureau of Standards to validate the certificates of conformity (CoCs) that accompanying these products.
It is expected that both proposals will enter into force in August 2017.
