Noida - The Food Safety and Standards Authority of India (FSSAI) has officially implemented a massive structural overhaul following the gazette notification of the Food Safety and Standards (Licensing and Registration of Food Businesses) Amendment Regulations, 2026. Alongside establishing perpetual business licenses and raising compliance thresholds, the apex regulator has enforced a strict nationwide crackdown banning deceptive health claims, absolute marketing phrases, and unauthorized medical terminology on all packaged foods and e-commerce platforms.
This aggressive dual policy radically shifts the regulatory framework for all Food Business Operators (FBOs) by combining simplified operations with zero tolerance for consumer deception.

Key Licensing & Turnover Highlights

Perpetual Validity: Food licenses and registrations issued will feature lifetime validity, completely removing the annual renewal process.

Annual Fee Model: In lieu of renewals, validity is sustained through a simplified annual regulatory fee structure paid online.

Turnover Ceilings Raised: Basic Registration thresholds jump from ₹12 Lakh to ₹1.5 Crore, shifting micro-entrepreneurs to low-compliance tiers.

State & Central License Realignment: State Licenses govern turnovers between ₹1.5 Crore and ₹50 Crore, while Central Licenses are reserved for operations exceeding ₹50 Crore.

Deemed Street Vendor Registration: Venders registered under the Street Vendors Act, 2014, receive automatic deemed FSSAI registration.

New Enforcement: Prohibited Claims & Marketing Bans

To curb public misinformation, the FSSAI has banned specific misleading branding and packaging practices under Section 53 of the FSS Act. Enforcement directives issued include:

Ban on Absolute Claims: Absolute assertions such as "100% Pure," "100% Natural," or "100% Safe" are strictly prohibited on packaged food labels unless scientifically and legally validated.

ORS Tag Restriction: The term "ORS" (Oral Rehydration Solution) is officially barred from all food and beverage labels unless the formula explicitly matches World Health Organization (WHO) formulation standards.

E-Commerce Liability: Digital product listings are held to identical physical labeling standards. Mismatched online descriptions, unverified "Organic" or "Vegan" tags, or unauthorized purity claims will trigger immediate delisting and penalties.

Heavy Penalties: Running misleading advertisements or misbranding labels now attracts severe structural penalties up to ₹10 Lakh, accompanied by immediate product recalls and potential license suspension.

System Execution

All applications, annual declarations, and fee payments must be processed exclusively through the unified FSSAI FoSCoS Portal. Routine physical audits are replaced by an automated, risk-weighted digital inspection schedule driven by compliance history. Failure to deposit mandatory fees or comply with the new labeling restrictions will result in automated system-generated operational suspensions.
