Why Your STEM OPT Extension Depends on Your Employer's E-Verify

Every year, tens of thousands of international students complete their degrees at U.S. universities and enter the workforce on Optional Practical Training authorization. A significant portion of those students later apply for the 24-month STEM OPT extension that allows them to remain and work in the United States while pursuing H-1B sponsorship. And every year, a preventable number of those extensions get denied for a reason that has nothing to do with the student's qualifications, their degree, or their job performance.

The reason is E-Verify. Specifically, the employer is not enrolled in it.

As awareness of U.S. immigration compliance requirements continues to grow among international students, understanding E-Verify has become less of an optional subject and more of an essential one. This article explains what the program is, how it intersects with OPT and STEM OPT authorization, and what students need to do before filing any paperwork.

The Federal System Behind the Requirement

E-Verify is an internet-based employment eligibility verification system administered by the U.S. Department of Homeland Security in partnership with the Social Security Administration. It works alongside Form I-9, the employment eligibility verification form that all U.S. employers are already required to complete for every new hire. Where I-9 is a paper or digital form completed at the time of hiring, E-Verify takes the information from that form and checks it electronically against DHS and SSA federal records in real time.

The system has operated since 1997 and has grown substantially in the years since. Participation is required for federal contractors and for employers in states with active E-Verify mandates. Many private employers have also enrolled voluntarily. The program is free for employers to use and the verification process typically returns a result within 24 hours for the vast majority of submissions.

Importantly, E-Verify does not replace Form I-9. Employers complete I-9 first and then initiate the E-Verify check using that same information. Once enrolled, an employer must use the system consistently for all new hires. Selective verification, such as running E-Verify only for foreign national employees while skipping others, is a violation of the program's Memorandum of Understanding with DHS and can result in compliance consequences for the employer.

The Critical Difference Between OPT and STEM OPT

Here is where the distinction that matters most to international students becomes clear.

During standard 12-month post-completion OPT, there is no federal requirement that the employer be enrolled in E-Verify. A student on initial OPT can work for any eligible employer regardless of whether that employer participates in the E-Verify program. The employer still completes Form I-9 and verifies the student's Employment Authorization Document, but E-Verify enrollment is not a legal prerequisite for the student's OPT work authorization during this phase.

The 24-month STEM OPT extension operates under an entirely different
framework. Federal regulation at 8 CFR section 214.2(f)(10)(ii)(C)(5) explicitly requires that the employer be enrolled in E-Verify as a condition of the extension. There are no exceptions based on employer size. There are no waivers based on industry. There is no grace period for employers who are in the process of enrolling when the student files. The enrollment must be complete and active at the time the I-765 application is submitted.

USCIS verifies this independently during adjudication. The agency checks the employer's E-Verify status directly through DHS systems, not through any documentation the student or employer provides. If the status is not active and confirmed at the time of adjudication, the application is denied. That denial results in immediate loss of work authorization and, depending on the timing relative to the student's F-1 status, can have broader immigration consequences.

Why This Catches Students Off Guard

The frequency with which STEM OPT denials occur due to E-Verify issues reflects a gap in how this requirement is communicated. Many employers, particularly smaller technology companies and startups that have not previously hired international students, are genuinely unaware that E-Verify enrollment is a legal precondition for employing a STEM OPT student. They may be excellent employers with strong training programs and genuine interest in sponsoring the student for an H-1B visa down the line. But if they have not enrolled in E-Verify, the student's STEM OPT extension cannot be approved regardless of those other factors.

Students who discover this problem at the filing stage, after their OPT has expired or is days from expiring, face an extremely difficult situation. The employer can enroll in E-Verify relatively quickly, but waiting for that process to complete while simultaneously managing expiring work authorization and a pending USCIS application creates a timeline that leaves very little room for error.

The straightforward solution is to check enrollment status early, well before the STEM OPT application is filed, and well before the current OPT period expires.

How to Verify Employer Enrollment Status

USCIS maintains an employer search tool at e-verify.gov that is updated daily. Searching by company name returns the employer's enrollment status, the date they signed their Memorandum of Understanding with DHS, how many hiring sites are registered under their account, and whether they have adopted E-Verify+, the updated version of the program that USCIS launched in April 2024 which integrates the I-9 and E-Verify processes into a single digital workflow.

These requirements work together as a package. E-Verify enrollment is the threshold condition, but the other requirements are equally non-negotiable from USCIS's perspective.
