Code 8.01-50, which defines a wrongful death as one caused by the wrongful act, neglect, or default of another party, and allows a court-appointed personal representative to bring a civil claim for the benefit of the statutory beneficiaries even after the injured person has died. "A criminal conviction is never required to bring a wrongful death claim," Gibson notes. "The two cases are separate, use different standards of proof, and can proceed on their own timelines."
Virginia wrongful death attorney Ken Gibson explains that under Va. Code 8.01-53, eligible beneficiaries typically include the surviving spouse, children and grandchildren of a deceased child, and, when there is no spouse or children, parents, siblings, or certain dependent household relatives. Because only one wrongful death claim can be filed on behalf of all beneficiaries, coordinating among family members early in the process is important, and the firm helps facilitate that communication when disputes arise over how a case should proceed.
Attorney John Singleton, Gibson's law partner, notes that fatal accidents can arise from a wide range of negligence, including car and truck crashes, motorcycle and pedestrian collisions, boating accidents on the York River and Chesapeake Bay, medical malpractice, and workplace incidents. "Trucking cases in particular often involve violations of federal motor carrier safety rules that can serve as powerful evidence of negligence," Singleton explains.
The firm notes that a medical malpractice wrongful death claim generally requires a certification, at the time service of process is requested, that the family has obtained a qualifying expert opinion, unless the alleged negligence clearly falls within a jury's common knowledge. Workplace fatalities, meanwhile, may involve both a workers' compensation claim and a separate third-party negligence claim against a contractor, subcontractor, or equipment manufacturer, depending on the circumstances of the incident.
Under Va. Code 8.01-52, families may recover economic damages such as funeral expenses, lost future income, and lost household services, along with non-economic damages for the loss of a loved one's companionship, guidance, and comfort. Punitive damages may also be available in cases involving willful or wanton conduct, though Virginia caps punitive damages at $350,000 in qualifying cases, and any recovery is distributed among beneficiaries under Va. Code 8.01-54.
Attorney Singleton adds that Virginia's strict contributory negligence rule remains one of the most contested issues in these cases, since a finding that the deceased shared even a small amount of fault can bar the family's recovery entirely. "Insurance adjusters know this rule well and often look for any indication of shared fault," he notes. "Building a complete evidentiary record early, through accident reports, witness statements, and expert testimony, is often what protects a family's claim."
Under Va. Code 8.01-244, a wrongful death action generally must be filed within two years of the death, a deadline that leaves families little room for delay while they are also grieving and arranging for a personal representative to be appointed through the appropriate circuit court.
