Relevant offers may appear on previously unknown online shops, deeply nested product pages, price lists, PDF documents or product images, making them difficult for trademark owners to identify comprehensively.

At the same time, digital sources are transient. Product names are changed, documents are replaced, pages are redirected to new addresses or removed entirely. A screenshot taken at a later stage shows only the current state. It does not reveal how long an offer had already existed, through which distribution channels it was visible or what changes had been made in the meantime.

With BrandGuard, borban has developed a platform that brings these previously separate tasks together in a continuous workflow. The system combines web-wide research into potential trademark uses with the technical analysis of complete websites, the reconstruction of historical page states, continuous monitoring and the structured preservation of digital evidence.

A single initial lead can therefore develop into a traceable case file: from the discovery of a previously unknown domain and the examination of related product pages and documents to chronological classification, evidence preservation and further case handling.

BrandGuard is designed for trademark owners, companies, manufacturers, legal departments, law firms and specialized service providers that want not only to identify potential trademark uses, but also to document their technical and chronological context in a traceable manner.

THE SEARCH BEGINS ACROSS THE WEB - NOT ON A KNOWN WEBSITE

Many conventional review processes require the website to be examined to be known in advance. This approach is not sufficient for comprehensive trademark monitoring. Anyone who checks only known providers will not discover new shops, additional distributors or documents published outside their existing field of view.

BrandGuard therefore begins at the discovery stage. After a trademark name has been entered, the platform can use connected search sources to research publicly discoverable uses across the web. The search is not limited to exact matches. Controlled spelling variants, different word separations, hyphenated forms and likely typographical errors can also be included.

The results are not presented as an unstructured list of individual links. BrandGuard groups findings by domain, checks their technical accessibility and classifies them using transparent signals. A use in a product title or on an identifiable sales page can therefore be prioritized differently from an incidental mention in a general text.

This makes it possible to identify previously unknown providers, shops and product findings without requiring users to know and enter their web addresses in advance. Relevant domains can then be transferred directly into more extensive investigation projects.

The public BrandGuard trademark web scan provides a limited technical preliminary check without requiring a user account. It displays initial publicly discoverable web signals and potential findings. A full investigation and permanent evidence file are created only within the protected BrandGuard workspace.

A SEARCH RESULT BECOMES THE STARTING POINT FOR AN IN-DEPTH ANALYSIS

A single search result usually represents only a small part of a website. The same trademark name may also be used on additional product pages, in categories, internal search results, documents or different product variants offered by the same provider.

BrandGuard therefore does not end the investigation at the first URL found. Its proprietary crawler can systematically explore the publicly accessible area of a website. Depending on the project configuration, it can take internal links, sitemaps, known product and document addresses, typical online-shop search routes, additional subpages and subdomains into account.

The platform analyzes more than visible text. It also records the technical state of a finding, including page titles, main headings, redirect chains, canonical references, structured data, indexing directives and HTTP header information.

These relationships can be important for subsequent assessment. It makes a difference whether a term appears only within a URL, is mentioned incidentally in body text or serves as the central name of a publicly discoverable sales offer.

BrandGuard records the origin and context of each finding separately. Users can see on which page, in which part of the page and under which technical conditions a designation was detected.

A simple keyword search is therefore transformed into a systematic investigation of the publicly accessible environment.

IMAGES AND SCANNED DOCUMENTS ARE ALSO EXAMINED

In online retail, trademark names are not always stored as machine-readable page text. They may appear only on packaging, labels, product photographs or embedded graphics.

Product sheets, catalogs, price lists and other PDF documents may also consist of scanned pages. A conventional text search cannot reliably identify such content.

BrandGuard therefore includes optical character recognition. It can extract visible text from product images and image-based documents and include the results in the wider investigation.

This makes it possible to detect trademark names even when they do not appear in the source code of a product page, but are visible only on the depicted product or within a scanned document.

The platform also records where an indication originated and how reliable the recognition is. A clearly legible product name is not treated in the same way as an uncertain character sequence extracted from a low-resolution image. Origin, location and recognition quality remain visible for further review.

HISTORICAL RESEARCH REVEALS WHAT IS NO LONGER VISIBLE TODAY

A current website often tells only part of the story. Product names may have been changed, offers removed, documents overwritten and earlier pages redirected to different addresses.

Anyone starting research at a later date may therefore find only a cleaned-up or completely altered website.

BrandGuard combines current analysis with historical web research. Where external archives provide corresponding data, earlier states of a finding can be identified, preserved and placed in chronological order. The platform uses available captures from the Internet Archive and URL references from Common Crawl, among other sources.

The historical analysis is not limited to a randomly selected snapshot. Different periods can be examined systematically in order to compare early, later and intermediate states of the same page.

This can reveal whether a trademark name previously appeared in a product designation or page title, was removed at a later stage or whether an offer continued under a different address. Changed headings, replaced documents and sales pages that disappeared in the meantime can also become part of a chronological record.

Current and historical evidence is combined within a shared timeline. Individual snapshots are therefore transformed into a traceable development history.

BrandGuard also makes the limitations of external archives visible. The absence of a capture does not prove that a page did not exist at a particular time. Likewise, the most recent available archived version does not automatically prove that a use ended at that point. Technical gaps and uncertainties remain visible as part of the documentation.

"In digital trademark cases, it is often not only the current content of a website that matters," explains Boris Banaszak, founder and developer of BrandGuard. "It can also be important to establish when a use can first be documented, how it changed over a longer period and which content was later removed or replaced. BrandGuard is designed to make that development visible without attributing more evidential weight to technical sources than they can actually support."

TECHNICAL EVIDENCE PRESERVATION GOES BEYOND A SCREENSHOT

A screenshot can provide an important snapshot, but it is often not sufficient for comprehensive technical documentation.

For example, it does not show which file was originally transmitted by the server, whether redirects were involved, which technical information was associated with the page or whether the preserved file was altered later.

Depending on the finding and project configuration, BrandGuard can therefore preserve not only visible page captures, but also HTML content, original PDF files, HTTP headers, redirect chains, extracted text, OCR results and additional page metadata.

Full-page screenshots and browser-rendered PDF files can also form part of an evidence unit. If a website is initially obscured by an age gate, cookie consent dialog or another access layer, that initial state can also be documented. Any subsequent interaction required to reach the actual content can be recorded, making it possible to trace how the page was accessed.

Original files and subsequent analyses are handled separately. The technical source file remains preserved as the captured state, while additional analyses, notes and case information can be added independently.

BrandGuard generates SHA-256 checksums for preserved files. These function like digital fingerprints: even a minor subsequent change to the file content produces a different value.

Source details, capture times, technical information and checksums are combined in manifests. A complete export can also include an overarching checksum file that allows the integrity of the included files to be verified.

BrandGuard deliberately describes this process as hash-based integrity documentation. The platform does not claim to create a qualified external timestamp automatically, nor does it make any judicial assessment of the later evidential value.

"A screenshot shows what was visible on a screen at a particular moment," says Banaszak. "Traceable technical documentation must also show where the content came from, how it was accessed, which data was actually available and whether the preserved files remained unchanged afterwards."

MULTIPLE PAGE STATES BECOME A COMPREHENSIBLE CASE HISTORY

A website may be examined repeatedly over months or years. Each review can show a different state.

If every capture were stored only as an individual file, the result would quickly become an unmanageable collection of screenshots, documents and technical information. BrandGuard therefore assigns related page states to shared evidence cases.

Within a case, users can see when a finding was first and most recently documented, which different versions are available and what changes were identified between individual review dates.

The system can, for example, document that a trademark name appeared in the page title during an earlier investigation but no longer appears in a later scan. Changes to headings, redirects, indexing settings or commercial indicators can also be traced.

BrandGuard distinguishes between current-only, historical-only and combined cases. A finding may still be accessible, may be documented only in a web archive or may be supported jointly by current and historical states.

A large number of individual technical data points is therefore converted into a comprehensible history of the relevant finding.

MONITORING IDENTIFIES NEW AND CHANGING DEVELOPMENTS

BrandGuard is not designed solely for one-time investigations. Trademark projects can be reviewed again at defined intervals.

The platform does not merely compare the total number of pages found. It examines how individual evidence cases and their technical states have changed.

This can reveal whether new domains have appeared, known pages have been modified, additional historical evidence has become available or the priority of a finding has increased.

Content that cannot be found again during a later review remains part of the documentation. BrandGuard deliberately labels it only as "not found again". This does not imply that the content has been permanently deleted or that the use has definitively ended.

Continuous monitoring can also begin again across the web. BrandGuard can regularly search for previously unknown domains and new findings and transfer relevant results into more extensive investigations.

The system therefore combines the recurring review of known cases with an ongoing search for new developments.

RESEARCH, EVIDENCE AND CASE MANAGEMENT IN ONE WORKSPACE

Work with BrandGuard does not end when a scan is complete. The platform includes a Legal Workspace in which preserved results can be processed in a structured manner.

Findings can be assigned to trademark projects, clients and digital legal files. Parties, opposing parties, jurisdictions, priorities, responsible team members, deadlines and chronological developments can be documented within a file.

Users can also add their own records. Correspondence, invoices, contracts, independently created screenshots and other documents can be managed together with automatically preserved web findings.

Files added manually also receive a checksum and can later be exported together with the technical web evidence.

Law firms and specialized service providers can manage multiple clients separately. Roles and permissions determine which users can access projects, evidence, cases, deadlines and other information.

The workflow therefore extends from the first web-wide discovery through technical and historical investigation to structured handling within a digital legal file.

STRUCTURED EVIDENCE PACKAGES INSTEAD OF SCATTERED INDIVIDUAL FILES

Once an investigation has been completed, BrandGuard can export the available information as a coherent evidence package.

Such an export can include a readable report, structured tables, project and case information, current page states, historical archive captures, timelines, monitoring comparisons, screenshots, browser-rendered PDFs, original HTML and PDF files, OCR results, technical metadata and the associated checksums.

It remains clear which content was originally preserved, which information was evaluated automatically and which details were added manually at a later stage.

Technical limitations, unavailable archive states and failed captures can also remain part of the documentation.

The result is not a loose collection of unrelated files, but an organized digital case file that can be reviewed internally or passed to a legal department, law firm or other qualified professional.

AN INDEPENDENTLY DEVELOPED END-TO-END SYSTEM

BrandGuard is not simply a user interface for a single external search or archive service.

The platform is based on an end-to-end system developed by borban that connects the individual stages of the process both technically and organizationally.

External search sources and web archives provide source data where available. The control of the research process, grouping of discovered domains, in-depth website analysis, detection logic, optical text recognition, chronological classification, formation of evidence cases, change monitoring, case management and creation of evidence packages all take place within the BrandGuard platform.

A domain discovered on the web can therefore be investigated, placed in historical context, technically documented, monitored continuously and assigned to a digital case file without switching between different tools.

BrandGuard brings together stages of work that, in practice, are often spread across several specialized solutions, manual research processes, spreadsheets and local file storage.

A proprietary quality layer monitors key system processes in the background and makes technical anomalies visible at an early stage. This component remains largely in the background for users, but supports stable operation and the controlled development of the platform.

BrandGuard is continuously expanded. Findings from live use, new technical capabilities and feedback from trademark owners, companies and law firms are incorporated into ongoing development.

FUTURE ANALYSIS WILL ALSO MAP DISTRIBUTION CHANNELS AND ECONOMIC REACH

As its next extension, borban is developing a module for reconstructing publicly visible distribution networks.

The planned analysis will combine historical retailer findings, product variants, price developments, documented sales indicators, branch networks and distribution periods.

The aim is not only to document individual offers in potential trademark infringement cases, but also to map the publicly visible distribution of a product in a systematic manner.

Based on the available data, BrandGuard is intended to calculate traceable revenue ranges in the future. The analysis will expressly distinguish between verified facts, publicly documented indicators and assumptions that are necessary for the calculation.

Such an assessment cannot replace complete commercial disclosure or access to internal sales records. It may, however, provide an initial economic assessment and indicate whether claimed sales volumes are plausibly consistent with the publicly visible extent of distribution.

"The economic significance of a trademark use should not be assessed solely on the basis of one isolated offer," explains Banaszak. "If a product can be documented over several years at different retailers, in several variants or within larger branch networks, a very different overall picture emerges. In the future, we intend to capture these relationships in a traceable manner without turning indicators into seemingly exact facts."

TECHNICAL SUPPORT WITHOUT AUTOMATED LEGAL DECISIONS

Despite its extensive functionality, BrandGuard does not decide whether a trademark infringement has occurred.

The platform documents publicly accessible content, technical states, sources, chronological developments and transparent risk indicators. It supports the discovery, prioritization, technical examination and structured preservation of potential findings.

Whether a specific use is legally permissible, who is responsible for it and which claims or measures may follow must continue to be assessed by appropriately qualified professionals on a case-by-case basis.

This distinction is part of the system design. BrandGuard makes technical uncertainties, incomplete sources and methodological limitations visible instead of concealing them behind an apparently definitive automated decision.
