New York law provides a statutory formula for calculating maintenance under Domestic Relations Law Section 236-B, and Manhattan's high cost of living makes these calculations particularly significant. Besinque advises that maintenance provisions should specify the payment amount, frequency, duration, and conditions under which support terminates, such as remarriage or cohabitation.

For separating parents with minor children, the agreement must address both custody and support. Child support in New York is calculated under the Child Support Standards Act, which applies a statutory percentage to combined parental income up to a cap of $193,000 as of March 1, 2026. The percentages range from 17 percent for one child to 35 percent for five or more children, with the court retaining discretion for income above the cap.

Besinque adds that a legal separation can serve as a step toward divorce. Under Domestic Relations Law Section 170(6), a spouse may seek a divorce after living separate and apart under a written separation agreement for six months or more, with satisfactory proof of substantial performance. The six-month period runs from execution of the agreement, and the agreement or a qualifying memorandum must be filed with the appropriate County Clerk if it will be used as the basis for a conversion divorce. When a separation converts to divorce, the agreement is typically incorporated but not merged into the judgment, remaining enforceable as an independent contract.
