This lower limit reflects the added safety responsibilities placed on those who operate large trucks, buses, and passenger vehicles throughout New York City. A first qualifying offense generally results in a one-year CDL disqualification, or three years for drivers transporting hazardous materials, while a second offense can result in lifetime disqualification under federal regulations.
Attorney Kugel adds that the consequences extend beyond commercial vehicles. Under federal rule 49 CFR Section 383.51, a DWI conviction in a personal vehicle can trigger the same CDL disqualification timeline as one that occurs while operating a commercial motor vehicle. "Many drivers are surprised to learn their commercial license is on the line even when they were off duty and driving their own car," she notes.
The firm also points to chemical test refusal as a particularly costly decision for CDL holders. A first refusal carries an 18-month CDL revocation under New York DMV rules, longer than the one-year disqualification that follows a first DWI conviction, while a later refusal can lead to permanent revocation for commercial drivers.
Kugel further advises that federal rules require CDL holders to notify their employer of a qualifying conviction within 30 days, and of any license suspension or disqualification before the end of the next business day after receiving notice. "Missing an employer notification deadline only adds another problem on top of the DWI case itself," she points out.
