Manhattan Divorce Attorney Richard Roman Shum Explains How Long

NEW YORK, NY - Couples seeking to end their marriage through an uncontested divorce in New York typically wait three to six months from the date of filing to the final Judgment of Divorce, though timelines vary based on court backlog, paperwork accuracy, and filing issues. Manhattan divorce attorney Richard Roman Shum of the Law Office of Richard Roman Shum, Esq (https://www.romanshum.com/blog/how-long-uncontested-divorce-takes-ny/) is providing guidance to spouses on what shapes that timeline and how to move the process forward efficiently.

According to Manhattan divorce attorney Richard Roman Shum, an uncontested divorce moves forward on documents alone when both spouses agree on every major issue, including property division, debt allocation, spousal maintenance, and any matters involving children. Most cases take at least three months because of statutory response periods and the court's administrative review. "An uncontested divorce is the most efficient path when both spouses can reach a full agreement," Shum explains. "But the process still has to move through fixed statutory steps, and the timeline depends heavily on whether the paperwork is complete and accurate from the start."

Manhattan divorce attorney Richard Roman Shum notes that under N.Y. Domestic Relations Law 230, at least one spouse must meet specific residency requirements before filing. Most uncontested cases proceed under the no-fault ground of "irretrievable breakdown" of the marriage for at least six months, as established under N.Y. Domestic Relations Law 170(7). Filing fees include $210 for the Index Number and an additional $125 for the Note of Issue and Request for Judicial Intervention, bringing total court filing fees to approximately $335.

Attorney Shum points out that the process follows a defined sequence: preparing and filing paperwork (one to four weeks), serving divorce papers (one to two weeks), the spouse's response period (20 to 40 days), court processing and review (two to four months), and the judge signing the final judgment (one to four weeks after submission). New York offers two filing methods, the traditional plaintiff-and-defendant approach and a joint filing where spouses act as co-petitioners, eliminating the need for service of process and the response waiting period.

The firm assists clients throughout Manhattan and the surrounding boroughs, with most uncontested cases reviewed by the New York County Supreme Court. Shum observes that case volume in that court can push processing toward the longer end of the typical range, making accuracy at every stage essential to avoid rejections that add weeks or months to the timeline.

"The biggest source of delay isn't disagreement between spouses, it's paperwork errors," Shum adds. "Missing signatures, incomplete financial disclosures, or improperly notarized documents are the leading reasons courts reject uncontested filings, and each rejection requires correcting and resubmitting."

Several factors can stall an otherwise straightforward case, including court backlogs, difficulties with service of process when a defendant is hard to locate, disputes that surface after filing, and additional review requirements when children under 21 are involved. A spouse who initially agreed to terms may change their mind after papers are filed, converting the case from uncontested to contested and dramatically extending the timeline, which is one reason a fully signed and notarized settlement agreement before filing is so important. Cases involving real estate, retirement accounts, pensions, or a business require careful drafting to avoid unintended financial consequences after the divorce is finalized.

For spouses preparing to file, finalizing the settlement agreement before submission, double-checking every form, and promptly serving papers are the most reliable ways to move the case forward without setbacks. Working with an attorney who regularly files in the New York County Supreme Court can help anticipate the specific requirements and common rejection reasons in that court, reducing the risk of avoidable setbacks. For those facing the end of a marriage, consulting a Manhattan family law attorney may help avoid the paperwork mistakes that slow so many cases down and provide a clearer path through the New York County Supreme Court's review process.
