Manhattan Divorce Attorney Juan Luciano Guides New Yorkers Through the Process of Asking for a Divorce
MANHATTAN, NY - Deciding to ask a spouse for a divorce involves emotional preparation, careful timing, and an understanding of New York divorce law. Manhattan divorce attorney Juan Luciano of Juan Luciano Divorce Lawyer (https://divorcelawfirmnyc.com/how-to-ask-for-a-divorce/) is offering guidance for individuals preparing to start this conversation and the legal process that follows.According to Manhattan divorce attorney Juan Luciano, New York's residency rules under Domestic Relations Law Section 230 determine whether a divorce case may be filed in the state, with required residency ranging from one to two years depending on the marriage's connection to New York. Since 2010, New York has also permitted no-fault divorce under Domestic Relations Law Section 170(7), allowing either spouse to file by stating that the marriage has been irretrievably broken for at least six months. "Knowing that no-fault divorce is available can ease some of the pressure people feel about having this conversation, because there is no need to build a case against a spouse or obtain a spouse's permission to proceed," Luciano explains.
Manhattan divorce attorney Juan Luciano notes that emotional preparation is often as important as legal readiness. Choosing a private, neutral setting during a calm period, avoiding holidays, arguments, or major life events, and setting realistic expectations for how the conversation may unfold can reduce unnecessary conflict. Building a support network, including therapists or counselors familiar with separation, may also help individuals manage the emotional weight of the decision before and after the conversation takes place.
Attorney Luciano adds that safety should come first in any situation involving a history of physical harm, threats, intimidation, or controlling behavior. "Individuals should not raise this conversation in person without a safety plan if there is any indication of past violence or control," he advises. New York Family Court may issue an order of protection under Family Court Act Section 842, and a temporary order may be granted under Family Court Act Section 828 for good cause even before the other spouse appears in court.
Once a spouse decides to move forward, clear and respectful communication can set the tone for every discussion that follows, including custody, finances, and property division. Direct, non-blaming "I" statements and allowing time for a spouse to process the news are among the approaches generally recommended, along with avoiding ultimatums or statements that assign blame. When children are involved, age-appropriate language and reassurance about day-to-day stability are typically advised.
A spouse's agreement is not required for a case to proceed, since New York's no-fault provisions allow a divorce to move forward even without the other party's cooperation. If a spouse does not respond after being properly served, the case may proceed by default, with response windows generally running between 20 and 30 days depending on how service was completed. Divorce actions are generally filed in New York Supreme Court in a county where one of the spouses resides, and service of the divorce papers must be completed by someone other than the filing spouse.
Luciano notes that once a divorce action begins, New York's automatic orders can limit major financial changes while the case is pending, generally restricting either spouse from transferring property, changing insurance beneficiaries, or taking on unreasonable debt outside ordinary expenses. "Gathering financial and legal documents early, including tax returns, bank statements, and records of marital property, can help avoid delays once a case is underway," he adds.
Under Domestic Relations Law Section 236(B), New York follows equitable distribution, meaning marital property acquired during the marriage is divided fairly rather than automatically split equally between spouses. Marriage certificates, prior agreements, property records, and documentation of marital debts are among the items recommended for organizing before a first consultation, since bringing these records to an initial meeting can help an attorney assess a case efficiently.
For those preparing to start this conversation or already navigating its aftermath, attorney Luciano and his office are available to discuss the legal and practical steps involved in a Manhattan divorce. Early legal guidance may help individuals protect their rights and prepare for the decisions that lie ahead.
