T.S.P., the court continued joint custody but assigned each parent final decision-making authority over specific subject areas after consultation. The firm cautions that joint custody is not appropriate in every situation. Courts generally find it unsuitable when there is domestic violence, child abuse, neglect, untreated substance abuse, or chronic high conflict. A pattern of one parent excluding the other from major decisions, or undermining the co-parenting relationship, can also weigh against joint custody. Long-distance situations create their own challenges, and in many cross-state arrangements one parent is designated the primary residential parent while the other receives extended parenting time during school breaks and summer.

Besinque outlines several practical signs that joint legal custody may work for a family. These include the ability to communicate calmly about a child's needs, willingness to compromise during disagreements, an absence of unilateral major decisions in the past, and the capacity to keep conversations focused on the child rather than personal history. Parents who live close enough to attend school events, medical appointments, and other activities also tend to manage joint custody more effectively, particularly across Manhattan and the surrounding boroughs.
