New Jersey DUI Attorney Rachel Kugel Outlines Aggravating

NEWARK, NJ - Drivers in New Jersey facing DUI or DWI charges may be exposed to significantly harsher penalties when certain aggravating factors are present, even though the state does not have a separate criminal statute formally labeled aggravated DUI. According to New Jersey DUI attorney Rachel Kugel, factors that elevate the seriousness of a DUI charge include a higher blood alcohol concentration, prior convictions, the presence of a minor in the vehicle, and incidents involving injury or death. While N.J.S.A. 39:4-50 sets the baseline framework for DUI offenses, additional statutes can apply when these aggravating elements are present. "A first-time DUI with a BAC just above the legal limit is treated very differently from a case involving a high BAC reading and a collision," Kugel explains.

New Jersey DUI attorney Rachel Kugel notes that BAC level is one of the most consequential factors. A first offense with a BAC of 0.08 to under 0.10 percent generally carries a $250 to $400 fine and a three-month ignition interlock device requirement. A first offense with a BAC of 0.15 percent or higher triggers a mandatory four- to six-month hard license suspension and an interlock obligation lasting nine to 15 months after restoration. Repeat offenses within ten years carry progressively harsher consequences, including 48 hours to 90 days in jail for a second offense and a mandatory 180-day jail sentence for a third.

The firm also addresses how having a minor passenger affects a DUI case. Under N.J.S.A. 39:4-50.15, a parent or guardian convicted of DUI or DWI while a passenger age 17 or younger is in the vehicle is guilty of a disorderly persons offense, which adds up to six months of license forfeiture and up to five days of community service to the underlying penalties.

"When impaired driving leads to bodily injury or death, prosecutors may move the case beyond municipal court," Kugel notes. A DUI causing serious injury can result in an assault by auto charge under N.J.S.A. 2C:12-1, and a fatal crash can lead to vehicular homicide charges under N.J.S.A. 2C:11-5. Both are indictable offenses handled in New Jersey Superior Court and carry potential state prison time.

Beyond fines and incarceration, New Jersey DUI convictions trigger significant financial obligations that extend for years. The current statute imposes a $125 surcharge under N.J.S.A. 39:4-50(i), and the Motor Vehicle Commission lists annual surcharges of $1,000 for three years on first and second DUI convictions and $1,500 for three years on a third offense. Ignition interlock installation and monthly maintenance fees, IDRC program fees, and the $100 license restoration fee add to the long-term cost. Insurance premiums for convicted drivers also rise substantially.

These include challenging whether the traffic stop was supported by reasonable suspicion under the Fourth Amendment, scrutinizing the calibration and operation of the Alcotest 9510 device currently used for breath testing in New Jersey, contesting blood test results based on chain-of-custody or storage issues, and questioning the administration of standardized field sobriety tests, which can be affected by medical conditions, road conditions, and weather.
