Coffee shop workers face a combination of hot equipment, repetitive tasks, heavy lifting, and fast-paced service that creates conditions where injuries happen regularly. Under the Pennsylvania Workers' Compensation Act, 77 P.S. 1 et seq., cafe employees who are hurt on the job may be entitled to medical benefits and wage loss compensation.
New Castle workers' compensation attorney Lawrence M. Kelly emphasizes that repetitive strain injuries develop gradually from tasks such as tamping espresso grounds, twisting steamer knobs, lifting heavy milk containers, and reaching overhead to restock supplies. These motions can lead to carpal tunnel syndrome, tendinitis, and what some medical professionals call "barista wrist." "Repetitive strain injuries that develop because of work duties qualify for workers' compensation benefits just like sudden traumatic injuries," Kelly notes.
Attorney Kelly adds that burns from hot beverages and equipment are a constant risk for cafe workers. A spill from coffee brewed at 195 to 205 degrees Fahrenheit can cause second-degree burns in seconds, and contact with steam wands or heated machine surfaces can produce serious injuries requiring emergency treatment. Slip-and-fall accidents from spills, wet floors, and cluttered walkways are another leading cause of workplace injuries in coffee shops.
Under Section 301(c)(1) of the Pennsylvania Workers' Compensation Act, 77 P.S. 411(1), a compensable work injury generally includes an injury arising in the course of employment. The workers' compensation system is no-fault, which means an injured barista does not need to prove employer negligence to receive benefits. Joseph A. "Workers' compensation provides several types of benefits to employees who suffer work-related injuries," Kelly explains. "Under Section 306 of the Pennsylvania Workers' Compensation Act, injured baristas may receive medical benefits covering all reasonable and necessary treatment, wage loss compensation that replaces approximately two-thirds of the average weekly wage up to a statewide maximum, and specific loss benefits for permanent injuries."
Kelly notes that filing a claim involves time-sensitive steps. Under Section 311 of the Pennsylvania Workers' Compensation Act, an injured worker must notify the employer within 21 days of the injury to protect retroactive wage payments, and waiting longer than 120 days may result in loss of benefits entirely. After the report is filed, the employer's insurance carrier has 21 days to accept, deny, or temporarily pay the claim while investigating.
