Karlsruhe Higher Regional Court Halts Tobacco Lifestyle Marketing Online: Clear Defeat for Online Retailers
Grafling, April 23, 2026 A significant blow to the tobacco industry: The Higher Regional Court of Karlsruhe has completely rejected the appeal of an online retailer of hookah tobacco, thereby confirming the legal position of Pro Rauchfrei e.V. (Judgment of April 8, 2026, Case No. 6 U 1/26). The court made it clear that even the attention-grabbing presentation of tobacco products on the internet violates the legal ban on advertising.
The specific case involved colorful banner ads on the homepage of an online store. The court deemed in particular the so-called "color explosions" behind the products to be impermissible advertising, as they specifically highlight the tobacco products and make them appear attractive. The court was clear: Such depictions are not neutral product information, but rather targeted sales promotion. In particular, the visual presentation acts like "fireworks," deliberately showcasing the products and enhancing their appeal.
In doing so, the court is taking a hard line: Even seemingly subtle design elements can constitute illegal advertising if they enhance products and create incentives to buy.
"The decision makes it unmistakably clear: Anyone who attempts to present tobacco as a lifestyle product is clearly acting outside the law," says Stephan Weinberger, Executive Director of Pro Rauchfrei e.V. "Colorful images are not harmless decoration. They are deliberate seduction, and that is precisely what is prohibited."
Pro Rauchfrei e.V. sees the decision as validation of its work. The association's goal is to protect consumers from the health risks of tobacco use and to consistently prevent unlawful advertising practices.
With this ruling, the Higher Regional Court of Karlsruhe underscores the high priority of health protection over economic interests and confirms: Advertising for tobacco products on the internet remains strictly prohibited, even in modern, graphically staged forms.
