Defendants are presented with three plea options at arraignment: not guilty, guilty, or no contest.

Attorney Yum advises that entering a not guilty plea at the arraignment is generally the recommended course of action, as it preserves the defendant's rights, provides time for the defense team to review discovery materials, and allows the attorney to negotiate with prosecutors before any decisions are finalized. "Pleading guilty at the arraignment means accepting the charges and penalties without giving an attorney the chance to review the evidence," she notes. "In many DUI cases, there are valid defenses that can lead to reduced charges or a dismissal."

For defendants released after booking, the arraignment date listed on the citation may be scheduled weeks or even months after the arrest, and the specific courthouse assignment depends on where the arrest occurred.

Bail determinations are also addressed at the arraignment. For standard first-offense misdemeanor DUI cases without aggravating factors, most San Diego judges permit release on the defendant's own recognizance. However, factors such as a blood alcohol content significantly above the legal limit, prior DUI convictions, an accident involving injuries, or a prior failure to appear in court may lead to bail requirements or additional conditions of release. Common release conditions in San Diego include attending alcohol monitoring programs or agreeing not to consume alcohol while the case is pending. Misdemeanor DUI arraignments differ from felony proceedings in several important respects. A DUI may be charged as a felony when the driver has three or more prior DUI convictions within ten years, when someone was injured or killed, or when a prior felony DUI conviction exists. Felony cases involve two separate arraignment hearings and require the defendant's personal appearance at each one. California law generally requires personal appearance at a DUI arraignment, though the San Diego Superior Court does allow qualifying misdemeanor DUI cases to proceed through a counter or fax arraignment process under local rule 3.1.2, where an attorney may enter a not guilty plea on the defendant's behalf.
