Under Leandra's Law, driving while intoxicated with a child aged 15 or younger in the vehicle is automatically a Class E felony on a first offense. A Class E felony DWI carries up to four years in state prison, fines between $1,000 and $5,000, and a minimum one-year license revocation. Both classifications require mandatory installation of an Ignition Interlock Device for at least six months and result in a permanent criminal record that is not eligible for sealing under CPL Section 160.59.
Attorney Kugel emphasizes that felony DWI cases in Manhattan follow a specific procedural path, beginning with arraignment at Manhattan Criminal Court at 100 Centre Street and proceeding through grand jury indictment to the New York County Supreme Court at 111 Centre Street for further proceedings. Defense strategies in felony DWI cases may include challenging whether law enforcement had reasonable suspicion to initiate the traffic stop, questioning the calibration and maintenance of breathalyzer equipment, and disputing the accuracy of field sobriety tests, which can be affected by medical conditions, fatigue, and environmental factors. For cases involving prior conviction enhancements, the validity of the underlying conviction records may also be contested.
Kugel advises that felony DWI charges frequently arise alongside additional criminal charges when an accident, injury, or death occurs. Vehicular assault in the second degree under Penal Law Section 120.03 is a Class E felony carrying up to four years in prison. Aggravated vehicular homicide under Penal Law Section 125.14 is a Class B felony with a maximum sentence of 25 years.
