Governed by 750 ILCS 5/501, the form is designed to provide the court and opposing party with a full picture of income, expenses, debts, and assets. "This document is foundational to how Illinois courts determine temporary support and attorneys' fees," Knight explains. "Even though the form is standardized, it rarely captures the full complexity of a client's financial situation."
Chicago divorce attorney Russell D. Knight notes that Cook County applies stricter rules than the baseline Illinois statute. Under Cook County Court Rule 13.3.1, the petitioner must serve a completed Financial Affidavit no later than 30 days after the initial pleading is served, and the respondent must do the same within 30 days of filing an appearance. Alternatively, the affidavit must be served at least seven business days before any scheduled hearing. Failure to comply can result in court sanctions under Illinois Supreme Court Rule 219.
Attorney Knight emphasizes that the Financial Affidavit must be accompanied by supporting documentation, including the most recent income tax returns, pay stubs, and banking statements, as required under 750 ILCS 5/501(a)(1). While the statute does not specify the exact quantity of documents required, Knight advises clients to include a full year's worth of financial records. "Providing comprehensive documentation from the start helps avoid delays and protracted discovery disputes," he notes.

Knight advises that parties who struggle to complete the affidavit accurately, such as self-employed individuals or business owners with irregular income, may use the supplemental Additional Information for the Financial Affidavit form to clarify their circumstances. The court's instructions require all questions to be answered, even if the response is "not applicable" or "not in my possession." Parties are expected to demonstrate that reasonable efforts were made to obtain the requested financial information.
Knight also highlights that the Financial Affidavit is not a one-time obligation. The document must be updated whenever a material financial change occurs - such as a change in employment, a significant new expense, or following the annual receipt of W-2s and 1099s. In post-judgment proceedings involving modification of child support or maintenance, an updated affidavit must again be served on the opposing party no less than seven days before any hearing. Under Cook County rules, if a party fails to file a compliant Financial Affidavit, the court may treat the opposing party's affidavit as competent evidence of the financial facts in dispute. As established in In re Marriage of Hubbs, 843 NE 2d 478 (Ill. App. 5th Dist. 2006), a financial statement submitted by one party can serve as binding evidence if the other party does not provide their own.
