Section 39:5-3.b of the New Jersey Revised Statutes requires that DUI charges be filed within 90 days of the alleged offense. This 90-day window is longer than the standard 30-day deadline that applies to most other traffic violations in the state. If a complaint is filed after the 90-day period has passed, a defense attorney may seek dismissal of the charge as untimely.
The right to a speedy trial under the Sixth Amendment to the U.S. Constitution provides an additional layer of protection for those facing DUI charges.
