Dear Members of Congress:

I write to you as an American citizen exercising my First Amendment right to petition the government for redress of grievances. I am bringing to your attention a matter of significant public concern involving the integrity and accountability of the United States Securities and Exchange Commission ("SEC") in the conduct of civil enforcement proceedings.

The government must be beyond reproach. When the SEC brings enforcement actions against American citizens, it wields the full power and authority of the federal government. It can seek financial penalties, disgorgement of assets, injunctions, and industry bars that can destroy a person's livelihood and reputation. With that extraordinary power comes an extraordinary obligation: the obligation to conduct its proceedings with absolute honesty, integrity, and adherence to the same standards of truthfulness that it demands of the citizens it regulates.

THE FACTS

On February 7, 2025, the SEC filed a Motion for Summary Judgment against me in the United States District Court for the Eastern District of Michigan, Southern Division, before the Honorable Judge Matthew F. Leitman. In support of that Motion, the SEC submitted 38 exhibits, including the sworn Declaration of Pesach Glaser (Exhibit 10, ECF No. 91-11), identified as an SEC accountant assigned to the litigation and the underlying investigation.

On May 16, 2025, the SEC itself filed a Notice (ECF No. 96) admitting that Mr. Glaser's sworn Declaration contained false statements regarding his professional credentials. Specifically:

False Statement 1: The Declaration stated that Mr. Glaser received "an MBA in accounting from Northwestern Kellogg Graduate School of Management." The SEC now admits this is false. Mr. Glaser received a Master of Management degree, not an MBA. The name of the institution was also stated incorrectly.

False Statement 2: The Declaration stated that Mr. Glaser has been "a certified public accountant licensed by the State of Illinois since 1984." The SEC now admits this is false. Mr. Glaser's Illinois CPA license lapsed in September 1990 - over 34 years ago. He held a registered status only briefly from June 2008 to September 2009. He is not currently, and has not been for decades, a licensed CPA in the State of Illinois.

These false credential claims were submitted to a federal court under penalty of perjury in a sworn declaration used to support a motion that, if granted, could result in significant financial penalties and other sanctions against me.

THE DOUBLE STANDARD

The SEC holds the citizens it investigates to the highest standards of truthfulness. False statements to the SEC are treated as serious federal offenses. Obstruction of SEC proceedings is charged as a crime. The SEC's own filing guidance warns that "a person who is found to have knowingly and willfully submitted false, fictitious, and/or fraudulent statements to the SEC may be subject to criminal sanctions under federal law."

Yet when the SEC's own staff submits a sworn declaration to a federal court containing verifiably false statements about professional credentials - credentials that go directly to the witness's qualifications and credibility - the SEC's response is a four-page notice expressing "regret" for the "inaccuracies" and stating that it is "considering what, if any, steps it should take."

This double standard is unacceptable. When the government demands absolute truthfulness from its citizens under threat of criminal prosecution, the government itself must be held to at least the same standard. A sworn declaration is not a casual document. It is a statement made under penalty of perjury, submitted to a federal court, relied upon by a judge in making decisions that affect a person's liberty and property.

THE QUESTIONS THAT REQUIRE ANSWERS

I respectfully request that Congress, through its oversight authority, seek answers to the following questions:

How did an SEC accountant submit a sworn declaration falsely claiming a degree he does not hold and a professional license that lapsed over 34 years ago? Was this deliberate misrepresentation or a failure of internal review?

What internal review processes does the SEC have for verifying the accuracy of sworn declarations before they are filed in federal court? Did those processes fail, or do they not exist?

Has the SEC taken any disciplinary action against Mr. Glaser or the attorneys who submitted the declaration? If not, why not?

How many other cases has Mr. Glaser provided sworn declarations or testimony in? Have those declarations been reviewed for similar false credential claims?

The SEC states it is "considering what, if any, steps it should take." What steps has the SEC actually taken?

Does the SEC apply the same standard of accountability to its own staff that it applies to the citizens it investigates?

REQUESTED ACTIONS

That the House Committee on Oversight and Government Reform and/or the Senate Committee on Banking, Housing, and Urban Affairs open an inquiry into the SEC's submission of false sworn declarations in federal civil proceedings.

That Congress request a full accounting of all cases in which Pesach Glaser has provided sworn declarations or testimony, and an independent review of his stated credentials in each.

That Congress request from the SEC a report on its internal procedures for verifying sworn declarations submitted by staff.

That Congress request a report on disciplinary actions taken in connection with the false statements in ECF No. 91-11.

That the SEC Office of Inspector General conduct an independent investigation and report its findings to Congress.

CONSTITUTIONAL FOUNDATION

The Fifth Amendment guarantees that no person shall be deprived of life, liberty, or property without due process of law. When the government submits false evidence to a court in support of a motion that could deprive a citizen of property, the integrity of the entire proceeding is compromised.

The Fourteenth Amendment guarantees equal protection under the law. The government cannot hold citizens to standards it does not apply to itself. If false statements to the SEC are grounds for criminal prosecution, then false statements by the SEC must be treated with equal gravity.

CONCLUSION

The government must be beyond reproach. The submission of a sworn declaration containing false credential claims to a federal court - in a proceeding that could result in significant penalties against an American citizen - falls below that standard. I have attached the SEC's own filing (ECF No. 96) as Exhibit A. The facts speak for themselves.

SEC Admits Its Own Expert Submitted False Credentials in Sworn Court Declaration; Congressional Oversight Requested

Agency that prosecutes citizens for false statements filed false sworn declaration in federal court

DALLAS, TX - Robert Shumake has requested formal congressional oversight after the United States Securities and Exchange Commission admitted in a federal court filing that its own expert witness submitted a sworn declaration containing false professional credentials.

In a Notice filed on May 16, 2025 (ECF No. 96), in the case SEC v. Robert Shumake, Case No. 2:21-cv-12193, the SEC acknowledged that the Declaration of Pesach Glaser - an SEC accountant - contained false statements about his educational credentials and professional licensing.

Specifically:

• Glaser falsely claimed he held an MBA from Northwestern Kellogg Graduate School of Management.
• He falsely claimed he has been a licensed Illinois CPA since 1984, when his license actually lapsed in 1990.

These false statements were submitted under penalty of perjury to support a motion that could result in financial penalties against an American citizen.
