Beverly Hills, California - AMZ Sellers Attorney® announced today a successful outcome in a United States Patent and Trademark Office (USPTO) ex parte reexamination proceeding, in which the USPTO rejected the challenged patent claim after full substantive review.

The reexamination was initiated to test the validity of a patent claim that was being asserted in a competitive marketplace context. Following examination by the USPTO's Central Reexamination Unit, the Office concluded that the challenged claim was not patentable in view of prior art and applicable legal standards, issuing a rejection under multiple statutory grounds.

According to the USPTO's Office Action, the claim was rejected as anticipated and unpatentable based on previously published references and earlier-filed disclosures, applying the ordinary observer and substantial similarity standards used in design and utility patent analysis. The Office determined that the claimed design or invention did not meet the requirements for patent protection when measured against the cited prior art and controlling precedent.
