US EPA Issues Final Rule for Formaldehyde Emissions Standard

On December 12, 2016, the US Environmental Protection Agency (EPA) published in the Federal Register its final rule and an associated certification program relating to Formaldehyde Emission Standards in Composite Wood. The new rule, required under Title VI of the Toxic Substances Control Act (TSCA), will become effective on February 10, 2017.

The EPA standard is based on the California Air Resources Board (CARB) formaldehyde emission standard.

Once the final rule is effective, individual compliance dates will come into effect as per the prescriptions of the law. Most requirements have a compliance date of December 12, 2017, with the exceptions of:

• Laminated products to comply with the hardwood plywood emission standard of 0.05 ppm - December 12, 2023
• Records demonstrating purchase/use of compliant platforms and NAF or phenol-formaldehyde (PF) resins and bills of lading, invoices, or comparable documents must be obtained and maintained for 3 years - December 12, 2023
• Importers to have import certification under TSCA section 13 - December 12, 2018

The final rule, entitled 40 CFR 770, remains unchanged from previous drafts and includes a provision for existing CARB approved Third-Party Certifiers (TPC) to provide certification to the new TSCA formaldehyde emissions standards for a period of two years without further approval.
