The attorneys and staff at Chaikin, Sherman, Cammarata & Siegel, P.C. extend our deepest condolences to the families devastated by the tragic flooding at Camp Mystic in Kerr County, Texas, over the July 4th weekend. As personal injury attorneys dedicated to protecting vulnerable people and holding institutions accountable, we are deeply troubled by what happened.

Parents trust summer camps with their children's lives. They expect safety to come first. Early reports suggest severe flood warnings had been issued, but evacuation procedures may have been lacking or simply too late-a fundamental betrayal of that trust. Children were put at risk. Families now face unimaginable grief that might have been prevented.

The Legal Duty to Keep Children Safe

Summer camps have a special legal responsibility for children's safety. This standard, in loco parentis , requires camps to provide the same care a reasonable parent would. When severe weather warnings are issued, this duty becomes critical.

Our partner Joseph Cammarata often reminds us: "When you assume responsibility for someone else's child, that responsibility is absolute. There can be no compromise when it comes to their safety."

If there were failures to heed National Weather Service warnings, it raises serious questions about negligence. If investigations confirm proper safety measures weren't followed, this wasn't just a tragic accident-it was a preventable disaster.

Questions That Need Answers

Search and rescue efforts must continue. But thorough investigations will follow. Key questions should include: When did camp administrators receive weather alerts? How did they respond? What communication existed between weather services, emergency officials, and camp leadership? Were flood plans in place? How well were they followed? Was staff properly trained? Why weren't children evacuated sooner from a flood-prone location?

These investigations aren't about blame. They're about understanding what went wrong to prevent future tragedies. Yes, the flooding was incredibly fast-the worst seen in that area of the Guadalupe River for forty years. But with today's weather forecasting technology, we can do better. We must do better.

The Need for Better Safety Standards

This tragedy isn't isolated. Across the country, institutions trusted with children's safety have failed their basic obligations. The legal system exists to ensure institutions cannot simply apologize and continue operating unchanged.

Legal action may provide some justice for affected families. But the broader goal must be systemic reform. We need mandatory weather monitoring systems with clear response plans. Enhanced staff training for emergencies. Improved oversight and regulation with regular safety inspections. Transparent reporting that lets parents assess a camp's safety record.

Our Commitment to Affected Families

To families directly affected: you are not alone. The legal community stands ready to support you in seeking truth and ensuring accountability. Your pain matters. Your voices deserve to be heard.

Document your experiences. Seek legal counsel to understand your rights. The investigation must be thorough, transparent, and focused on preventing similar incidents.

We cannot bring back what was lost. But we can ensure no other families face such devastating consequences from preventable institutional failures.

As we monitor developments, we remain committed to advocating for families and children's safety. Our thoughts remain with all those affected. Justice delayed is justice denied-we will continue supporting efforts to ensure accountability and reform follow this preventable disaster.
