Vermont Delays the Reporting Start Date for Chemicals of High

Following the signing into law of bill H.595 by the governor of Vermont on June 1, 2016, the start date for reporting Chemicals of High Concern to Children (CHCC) has been delayed until January 1, 2017.

In 2014, the US State of Vermont enacted S.239 as 18 V.S.A. Chapter 38A which requires a manufacturer or trade association representative to report, to the Vermont Department of Health, the presence of certain chemicals in products aimed at children under 12 years of age. The adoption of H.595, a multi-part law entitled, “An act relating to potable water supplies from surface waters”, has removed the July 1, 2016 start date and added a new section requiring a manufacturer submit the notice by January 1, 2017, followed by a second notification on August 31, 2018. Following the second date, manufacturers and trade association representatives will be required to submit notification biennially.

This law covers products aimed at children under the age of twelve, including: clothing, cosmetics, jewelry, toys, child car seats, and products to help children with sucking or teething, in order to facilitate sleep, relaxation, or feeding. The CHCC must be reported if it is an accessible component of a child’s product if the CHCC is intentionally added at a level above Practical Quantification Limit (PQL), available from the Vermont Department of Health. The CHCC must also be reported if it is present as a contaminant (> 100 ppm).
