German giant Gemu GmbH settles with American small business Microstein

Less than a year after opening its Swiss cleanroom manufacturing facility dedicated to the medical market, the German firm Gemu GmBH, has already decided to abandon all patents held in regards to its flip tube medical product range. This came after Microstein announced its intent to file re-examination proceedings against Gemu in the US patent office citing Microstein’s own PCT for its patented flip tube and other prior art including Japanese patent JP 2002-193300. After reviewing the prior art Gemu took the decision not to try to defend their patent. In a letter to Microstein on August 08, 2013 Gemu asserts that it will abandon all patents US 7,749,452 and EP 1 671 701 B1 for its flip tube
Microstein is pleased with the Gemu decision to abandon all patent claims as Gemu’s flip tube is substantially similar to the Microstein ergonomic microtube and the Japanese microtube described in JP 2002-193300. To assure that Gemu complies with its promise of abandonment, Microstein is continuing with the re-examination proceedings to invalidate Gemu’s patents until such time as Gemu files abandonment documents with the relevant patent office’s.
Microstein is currently reviewing its position in regards to patent infringement proceedings and damage claims against Gemu and its licensee’s of the flip tube.

Microstein is a US based company which developed and has been selling its ergonomic, contamination free microtubes since 2004.

Gemu is a German based company who’s flip tube product was launched in 2010. That year they were awarded the G.I.T. Laboratory Journals’ “innovations of the year” award based on the “innovation, novelty and new design” of the product.

Microstein is a US manufacturer of high quality laboratory plastics.
