Las Vegas Immigration Attorney Helps Abused Non-Citizen

CLEVELAND, OHIO - Las Vegas immigration (www.immigrationman.com) attorney Jonathan A. Bartell wants to use a new federal rule that begins this year to help his abused non-citizen client get a green card.

The rule protects imprisoned people in immigration detention centers, according to a story about immigration detainees seeking prison rape protection which stems from an immigrant detainee facing deportation to India. He was sexually abused by three gang members while jailed in Illinois.

Although he came to the U.S. on a work visa, he was taken into federal custody at work by immigration officials after he overstayed the visa. While incarcerated for years, he suffered the abuse that he reported, but he wasn’t released until he got an immigration lawyer.

He is still fighting to remain in the U.S. with his wife and kids, and get a visa available to victims of crime.

About 200 sexual abuse complaints were filed with the federal government within the past five years. Physical abuse is prevalent, but an ACLU official said the number is under-reported since many detainees cannot report the abuse as they do not speak or read English well, or know their legal rights while in the U.S.

Bartell, an asylum lawyer (www.immigrationman.com/Immigration/Asylum-Refugee.asp), is working on a case involving a man who was abused while he was detained after he was caught by immigration officials. The man is in the U.S. illegally.

"While in detention, he was severely beaten by another inmate," said work visa lawyer (www.immigrationman.com/Immigration/Employment-Visas.asp) Bartell. "This inmate was in jail for a criminal violation, yet he was being held in the same area as the non-criminal immigration inmates."

Bartell, also a DUI attorney (www.immigrationman.com/Criminal-Defense/DUI-DWI-attorney.asp), said he will attempt to get his client a green card as a victim of crime. The Columbus visa attorney works on various immigration and criminal cases for non-citizens.

"My goal is to protect people," he said of his initiatives to increase representation for people in places such as the immigration detention centers.
